Report of Regents Professional Practice Committee to The Board of Regents

Your Professional Practice Committee held its scheduled meeting on November 19, 2013. All Committee members were present, except for Regent James E. Cottrell who was excused. Regent James C. Dawson was also present but did not vote on any case or action.

ACTION ITEMS

Professional Discipline Cases
Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 5 cases. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 42 consent order applications and 6 surrender applications be granted. [PPC EXS (A) 1-3]

In the case of Doreen M. Varrichio-Prine, Registered Professional Nurse, Calendar No. 26269, we recommend that the caption, header, and body in the report of the Regents Review Committee as well as the caption on the blue back to the report all be deemed corrected to read respondent’s correct Calendar No. “26641”, and not “26441”.

These recommendations are made following the review of 53 cases involving thirteen licensed practical nurses, thirteen registered professional nurses, seven certified public accountants, five licensed practical nurses who are also registered professional nurses, three dentists, one chiropractor, one licensed clinical social worker, one nurse practitioner, one pharmacist, one pharmacy, one respiratory therapist, and one respiratory therapy technician.

Restorations

Your Committee recommends the following:

That the application of Thomas J. Byrne for the restoration of his license to practice as a physician in the State of New York be granted. [PPC EXS (A) 4]

That the execution of the surrender of the registered professional nurse license of Jeanne Marie Eberle be stayed; that she be placed on probation under the Terms of Probation attached to the Report of the Committee on the Professions as Exhibit A; that the period of probation end three years following successful completion of the nursing refresher course required by the Terms of Probation; and that, upon successful completion of the probationary period, her license be fully restored. That the execution of the surrender of Daniel L. Drucker’s license to practice as a certified public accountant in New York State be stayed; that he be placed on probation for a period of three years under the Terms of Probation attached to the Report of the Committee on the Professions as Exhibit A; and that, upon successful completion of probation, his license be fully restored. Approvals
Your Committee recommends approval of the following:

Regulations Relating to Administration of Vaccinations by Pharmacists [PPC (A) 1] – That paragraph (2) of subdivision (b) of section 63.9 of the Regulations of the Commissioner of Education be amended, as submitted, effective December 4, 2013.

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on November 19, 2013, copies of which have been distributed to each Regent.
