Report of Regents Professional Practice Committee to The Board of Regents

Your Professional Practice Committee held its scheduled meeting on May 16, 2016.  All members were present, except Regent Josephine Victoria Finn, who was excused.  Chancellor Betty A. Rosa, Regent Elizabeth S. Hakanson, Regent Judith Johnson, and Regent James R. Tallon, Jr. were also present, but did not vote on any case or action.

ACTION ITEMS

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 3 cases. In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 31 consent order applications and 11 surrender applications be granted. [PPC EXS (A) 1-3]

These recommendations are made following the review of 45 cases involving twelve licensed practical nurses, six pharmacists, six registered professional nurses, three certified public accountants, three dentists, two optometrists, two podiatrists, two registered professional nurses who are also nurse practitioners (Psychiatry), one chiropractor, one midwife, one podiatry professional corporation, one professional engineer, one registered professional nurse who is also a nurse practitioner (Family Health), and one veterinarian.

Restorations

 Your Committee recommends the following:

That the application of Olivera Bedic for the restoration of her license to practice as a physician in New York State be denied. [PPC EXS (A) 4]

Approvals

Proposed Amendment of Sections 76.6, 76.7, 76.8, 76.9 and 76.10 of the Regulations of the Commissioner of Education Relating to the Licensure of Occupational Therapy Assistants

Your Committee recommends the following:
That subdivision (a) of section 76.6, section 76.7, subdivision (a) of section 76.8, subdivision (b) of section 76.9, paragraph (3) of subdivision (a) of section 76.10 and paragraph (1) of subdivision (j) of section 76.10 of the Regulations of the Commissioner of Education be amended, as submitted, effective May 18, 2016, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the public health and general welfare to conform the Regulations of the Commissioner of Education to timely implement the requirements of Chapter 470 of the Laws of 2015, which establishes the requirements for licensure of occupational therapy assistants.  [PPC (A) 1] 

MOTION FOR ACTION BY FULL BOARD

Madam Chancellor and Colleagues: Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on May 16, 2016, copies of which have been distributed to each Regent.
