Report of Regents P-12 Education Committee to The Board of Regents

The P-12 Education Committee held its scheduled meeting on July 17, 2023. All members were present except for Vice Chancellor Josephine Victoria Finn, Regent Christine D. Cea and Regent Shino Tanikawa who were excused. Chancellor Young and Regents Luis O. Reyes, Susan W. Mittler, and Adrian I. Hale also attended the meeting but did not vote on the action items.

ACTION ITEMS

Proposed Amendment to Section 100.2(ee) of the Regulations of the Commissioner of Education Relating to Providing Flexibility for the Two-Step Identification Process for Academic Intervention Services (AIS) for Students Enrolled in Grades 3-8 for the 2023-2024 School Year [P12 (A) 1] - Department staff presented a proposed regulatory amendment to provide flexibility in the two-step identification process for Academic Intervention Services for students enrolled in grades 3-8 in the 2023-2024 school year.

The Committee recommends that the Board of Regents finds that section 100.2(ee) of the Regulations of the Commissioner of Education be amended, as submitted, effective July 18, 2023, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately provide flexibility for the two-step identification process for academic intervention services (AIS) for students enrolled in grades 3-8 for the 2023-2024 school year, and any other school year where the results of the grades 3-8 assessments are not provided to schools prior to the beginning of the school year.

The motion passed unanimously.

Proposed Amendment to Sections 114.3 and 114.4 of the Regulations of the Commissioner of Education Relating to School Food Service Programs and Bidding Exemptions for Purchasing New York State Food and Milk [P12 (A) 2] - Department staff presented for emergency action a proposed amendment to conform the Commissioner’s regulations to Part OO of Chapter 58 of the Laws of 2023, which amended the General Municipal Law regarding bidding exemptions for purchasing New York State food and milk for school food service program(s).

The Committee recommends that the Board of Regents finds that sections 114.3 and 114.4 of the Regulations of the Commissioner of Education be amended, as submitted, effective July 18, 2023, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately conform the Commissioner’s regulations to Part OO of Chapter 58 of the laws of 2023.

The motion passed unanimously.

MOTION FOR ACTION BY FULL BOARD

The P-12 Education Committee recommends, and we move, that at its meeting on July 18, 2023, the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations, copies of which have been distributed to each Regent.

MATTERS NOT REQUIRING BOARD ACTION

Deputy Commissioner Angelique Johnson-Dingle reviewed the items on the Consent Agenda.
