Report of Regents P-12 Education Committee to The Board of Regents

Your P-12 Education Committee held its scheduled meeting on February 10, 2020.  All members were present except Regent Mittler, who was excused.

ACTION ITEMS

Perkins V Plan [P-12 (A) 1 Revised]

Your Committee recommends that the Board of Regents approve the revised New York State Perkins V Plan as attached and direct staff to forward the plan and supporting documents to the office of the Governor for review and subsequently to the US Department of Education no later than April 15, 2020.

The motion passed.

Revisions to Charters Authorized by the Board of Regents [P-12 (A) 2 Revised]

Your Committee recommends that the Board of Regents finds that: (1) the charter school meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the charter school can demonstrate the ability to operate in an educationally and fiscally sound manner; (3) granting the request to amend the charter is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of Article 56 of the Education Law; and (4) granting the request to amend the charter will have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the charter revisions for Global Community Charter School and amends the provisional charter accordingly.

Your Committee recommends that the Board of Regents finds that: (1) the charter school meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the charter school can demonstrate the ability to operate in an educationally and fiscally sound manner; (3) granting the request to amend the charter is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of Article 56 of the Education Law; and (4) granting the request to amend the charter will have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the charter revisions for Growing Up Green Charter School II and amends the provisional charters accordingly.

The motion passed.  Regents Cashin, Collins, and Reyes abstained from the vote. 

Renewal Recommendations for Charter Schools Authorized by the Board of Regents [P-12 (A) 3]

Your Committee recommends that the Board of Regents finds that the South Bronx Early College Academy Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of the South Bronx Early College Academy Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2023.

Your Committee recommends that the Board of Regents finds that the West Buffalo Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of the West Buffalo Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

Your Committee recommends that the Board of Regents finds that the Bronx Community Charter School: (1) meets the requirements set out in Article 56 of the Education Law and all other applicable laws, rules, and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of the Bronx Community Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

 Your Committee recommends that the Board of Regents finds that the Mott Haven Academy Charter School: (1) meets the requirements set out in Article 56 of the Education Law and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of the Mott Haven Academy Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

The motion passed.  Regents Cashin and Collins abstained from the vote.

Madam Chancellor and Colleagues: Your P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on February 11, 2020, copies of which have been distributed to each Regent.

Review of the Graduation Rate for the 2015 Cohort that Successfully Graduated in 2019

Interim Commissioner Tahoe presented to your Committee on high school graduation rates based on the cohort of students entering grade 9 in 2015.

Substantial Equivalency of Instruction for Nonpublic Schools [P-12 (D) 1]

Your Committee discussed the comments received on the proposed addition of Part 130 of the Regulations of the Commissioner of Education relating to substantially equivalent instruction for nonpublic school students. NYSED staff provided an overview of next steps.

Consent Agenda

The Board of Regents will take action on the following consent agenda item at its February 11, 2020 meeting:

  • Proposed Amendment to Section 100.5 of the Commissioner’s Regulations to allow transfer of credits by attestation and exempt certain physical education provisions for students attending an educational program operated by juvenile and criminal justice agencies.
