Your Professional Practice Committee held its scheduled meeting on October 17, 2011.  All Committee members were present except Regent James E. Cottrell, who was excused.  

ACTION ITEMS

Professional Discipline Cases

Your Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 5 cases.  In addition, your Committee recommends, upon the recommendation of the Committee on the Professions, that 64 consent order applications and 5 surrender applications be granted.  [PPC EXS (A) 1-3]

In the case of Scott Burko, Pharmacist, Calendar No. 25859, we recommend that the September 13, 2011 Vote and Order in this matter and the Application To Surrender License granted in this matter each be deemed corrected solely insofar as the calendar number of “25860” shown on each of said documents shall reflect the correct calendar number in this matter and be deemed to read the correct calendar number of “25859”; and that the determination rendered on September 13, 2011 shall otherwise remain in full force and effect.

In the case of Mario J. Caruso, Jr., Pharmacist, Calendar No. 25860, we recommend that the September 13, 2011 Vote and Order in this matter and the Application To Surrender License granted in this matter each be deemed corrected solely insofar as the calendar number of “25859” shown on each of said documents shall reflect the correct calendar number in this matter and be deemed to read the correct calendar number of “25860”; and that the determination rendered on September 13, 2011 shall otherwise remain in full force and effect.

In the case of Jillian Rose Kelly, Licensed Practical Nurse, Calendar No. 25964, we recommend that the September 13, 2011 Vote and Order in this matter and the Report of the Regents Review Committee, Statement of Charges, and Terms of Probation in this matter each be deemed corrected solely insofar as the calendar number of “25304” shown on each of said documents shall reflect the correct calendar number in this matter and be deemed to read the correct calendar number of “25964”; and that the determination rendered on September 13, 2011 shall otherwise remain in full force and effect.

These recommendations are made following the review of 74 cases involving twenty-one registered professional nurses, seventeen licensed practical nurses, six licensed practical nurses who are also registered professional nurses, six pharmacists, three architects, two physical therapists, two podiatrists, one acupuncturist, one certified public accountant, one dentist, one dentist who is also a holder of a dental enteral conscious sedation certificate, one psychologist, one registered professional nurse who is also a nurse practitioner, one licensed clinical social worker, one licensed mental health counselor, and one nurse practitioner.

APPROVALS

Your Committee recommends approval of the following items:

Regulations Relating to Pharmacy [PPC (A) 1] – Action on Regents Rule related to the use of customized packaging of medications for patients on complex medication regimens. (Discussed in May 2011)

Regulations Relating to Public Accountancy [PPC (A) 2] – Emergency action on regulations to implement a 2011 law authorizing certain certified public accountants licensed in other states to practice in New York.

Madam Chancellor and Colleagues:  Your Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on October 17, 2011, copies of which have been distributed to each Regent.
