              Your P-12 Education Committee held its scheduled meeting on July 19, 2010.  All Committee members were present. 

ACTION ITEMS

 

National Center and State Collaborative Consortium on Alternate Assessments on Alternate Achievement Standards

Your Committee recommends that the Board of Regents accept the invitation for New York to be a Collaborating State in the Consortium on Alternate Assessments on Alternate Achievement Standards.  [P-12 (A) 5]

Waivers from Age and Four-year Limitations for Senior Athletic Competition

           Your Committee recommends that section 135.4(c)(7)(ii)(b)(1) of the Regulations of the Commissioner of Education be amended, and that section 135.4(c)(7)(ii)(d) of the Commissioner’s Regulations be added, as submitted, effective July 27, 2010, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to timely implement for the 2010-2011 school year the process for granting waivers from the age and four-year limitations for senior athletic competition to eligible students with disabilities, and thereby permit their timely participation in non-contact athletic competition for a fifth season in high school.  [P-12 (A) 6]

Academic Intervention Services (AIS)

              Your Committee recommends subdivision (ee) of section 100.2 of the Regulations of the Commissioner be amended as submitted, effective July 27, 2010, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately establish modified requirements for the provision of Academic Intervention Services for the 2010-2011 school year, for purposes of minimizing the potential fiscal impact on school districts of an anticipated change in cut scores for the grades 3-8 assessments in English language arts and mathematics, and thereby ensure the timely implementation of the modified AIS requirements by school districts in the 2010-2011 school year.  [P-12 (A) 17]

Charter School Actions

 

Your Committee recommends that the Board of Regents approves the proposed revision to the initial charter of the Leadership Preparatory East New York Charter School as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.  [P-12 (A) 1]

Your Committee recommends that the Board of Regents approves the revision to the first renewal charter of the Excellence Charter School of Bedford Stuyvesant as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.   [P-12 (A) 2]

Your Committee recommends that the Board of Regents: (1) approves the revision to the initial charter of the Crown Heights Collegiate Charter School as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; (2) approves the revision to the initial charter of the East New York Collegiate Charter School as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; (3)  approves the revision to the first renewal charter of the Excellence Charter School of Bedford Stuyvesant as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; (4) approves the revision to the initial charter of the Girls Preparatory Charter School of East Harlem as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; (5) approves the revision to the initial charter of the Leadership Preparatory Charter School 3 as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; and (6) approves the revision to the initial charter of the Leadership Preparatory East New York Charter School as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.    [P-12 (A) 3]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of the Achievement First Endeavor Charter School as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.  [P-12 (A) 7]

Your Committee recommends that the Board of Regents approves the revision to the first renewal charter of the Achievement First Crown Heights Charter School, as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.  [P-12 (A) 8]

Your Committee recommends that the Board of Regents approves the revision to the first renewal charter of the Brighter Choice Charter School for Boys, and the provisional charter is amended accordingly.   [P-12 (A) 9]

Your Committee recommends that the Board of Regents approves the revision to the first renewal charter of the Brighter Choice Charter School for Girls, and the provisional charter is amended accordingly.  [P-12 (A) 10]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of Brownsville Ascend Charter School as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.  [P-12 (A) 11]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of the Girls Preparatory Charter School of East Harlem as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly; and that the Board of Regents approves the revision to the first renewal charter of the Girls Preparatory Charter School of New York as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.  [P-12 (A) 12]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of the Girls Preparatory Charter School of East Harlem as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.  [P-12 (A) 13]

Your Committee recommends that the Board of Regents approves and issues the second renewal charter of the Harlem Link Charter School as proposed by the Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including July 31, 2013.  [P-12 (A) 14]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of Riverton Street Charter School as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.  [P-12 (A) 15]

Your Committee recommends that the Board of Regents approves the revision to the fourth renewal charter of the Harriet Tubman Charter School, and the provisional charter is amended accordingly.  [P-12 (A) 16]

Your Committee recommends that the Board of Regents approves and issues the second renewal charter of the Opportunity Charter School as proposed by the Chancellor of the city school district of the City of New York, and that its provisional charter be extended for a term up through and including June 30, 2012.  [P-12 (A) 18]

 

 

MOTION FOR ACTION BY FULL BOARD

             

              Madam Chancellor and Colleagues:  Your P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on July 19, 2010, copies of which have been distributed to each Regent.

 

MATTERS NOT REQUIRING BOARD ACTION

Appointment of Public Members of Boards of Education of Special Act School Districts – The Committee discussed proposed amendments to regulations that would allow for more flexibility for the appointment of public members to serve on boards of education of special act school districts.   It is sometimes difficult to find persons willing to serve at the current prescribed times (four consecutive years from July 1-June 30).  These proposed regulations would provide flexibility based upon the public members’ availability to serve.  It is anticipated that the proposed amendment will be presented to the Board of Regents for adoption at the September 2010 Regents meeting.     [P-12 (D) 1]

Timeline to Complete the P-20 Data System – The Committee was provided with an update on the work underway to carry out a major expansion of the Department’s data system, along with faster reports for data verification and a broad array of edit checks to improve data quality.  A timeline was provided showing key actions currently being taken.  The Committee discussed the possibility of including other sectors of higher education in the future (independent and proprietary colleges), as well as strategies to include data from pre-school providers.  [P-12 (D) 2]

Academic Intervention Services and the Response to Intervention Process – the Committee discussed proposed amendments to regulations that would allow a school district to provide a Response to Intervention (RTI) program in lieu of providing Academic Intervention Services (AIS) to eligible students, provided that certain conditions are met.  The proposed amendment would provide flexibility and allow school districts to:  (1) continue with a current AIS model; (2) move to or expand on an RTI model, or (3) use a blended approach of AIS and RTI.   It is anticipated that the proposed amendment will be presented for adoption at the October 2010 Regents meeting.  The Committee has asked that more information on RTI be included in the presentation in October.
