Should the Regents approve the recommendations of the Committee on the Professions pertaining to licensing petitions as listed on the attachment?
Proposed Handling
This question will come before the Professional Practice Committee at its March 2008 meeting where it will be voted on and action taken. It will then come before the full Board at its March 2008 meeting for final action.
Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 5 licensing petitions and 8 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective March 18, 2008.

Petition for: Waiver of New York State requirements pertaining to acceptability of licensing examinations
Statement of Problem: The Uniform National Examination (UNE) was last given in 1991. The Council of Landscape Architectural Registration Boards (CLARB) changed to the Landscape Architecture Registration Examination (LARE) in 1992. Mr. Gilchrest passed a total of six sections of the national licensure examination, three in June 1991 when the examination administered was the UNE and three after it had changed to the LARE. CLARB has established equivalencies between the changing sections of the examination. According to those equivalencies, the six sections that the applicant passed do not cover the full content of either examination. He lacks two sections of the current examination.
The Office of the State Board for Landscape Architecture estimates that the applicant has passed between sixty to seventy percent of the content of any given version of the examination. Mr. Gilchrest satisfied the examination requirement in Connecticut, his initial state of licensure, based on his passing of the six sections of both examinations. He is requesting that, in view of over 16 years of professional experience in Connecticut, his qualifications be accepted to satisfy the licensing examination requirement. The Executive Secretary of the State Board for Landscape Architecture supports his request.

Section 7324 of Education Law and Part 79-1 of the Regulations of the Commissioner of Education require for the examination route: |

(1) Approved four-year bachelor's (or higher) degree in landscape architecture and four (or three) years of acceptable experience or twelve units of acceptable education/experience credit. |

(2) Acceptable scores on all parts of a satisfactory licensing examination [Uniform National Exam (UNE) or subsequent Landscape Architecture Registration Examination (LARE) produced by the Council of Landscape Architectural Registration Boards (CLARB)]. OR Section 59.6 of the Regulations of the Commissioner of Education requires for endorsement of another state license satisfactory education/experience, satisfactory examination, at least two years professional experience following licensure in another jurisdiction. |

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy Examination.
Statement of Problem: As of October 1, 2007, John C. Kirchner, an applicant for licensure as a CPA, has passed all four sections of the Uniform CPA Examination. The applicant received conditional credit for the paper-based Accounting & Reporting section and the Business Law & Professional Responsibility section of the Uniform CPA Examination in November 1999. Under regulations in effect at that time, he needed to pass the remaining two sections of the examination within 36 months (by November 2002) to retain credit for the two sections he passed.
Mr. Kirchner was called to active military duty in January 2000, two months after passing the first two sections of the exam. He was stationed overseas and remained on active duty for four years, with frequent deployment to hostile fire zones. On December 30, 2003, he was discharged from active duty at the rank of Captain, having served during Operation Iraqi Freedom. Mr. Kirchner had and continues to have some service-related disabilities, as documented by the Veterans Administration.
Mr. Kirchner’s primary focus upon returning to the U.S. was the resumption of civilian life, including reacquainting himself with his wife and young child and resuming his postponed career with an accounting firm. Once these details began to settle, he was able turn his attention to preparing for the remaining two sections of the CPA exam. In August 2007, he sat for the Financial Accounting and Reporting (FAR) section, passing with a score of 84. In October 2007, he sat for the Audit (AUD) section of the exam, passing with a score of 94.
The Executive Secretary for the State Board for Accountancy supports Mr. Kirchner’s request to waive the 36-month requirement to pass all four parts of the Uniform CPA Examination.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Public Accountancy, recommends that the applicant’s petition for acceptance of passing grades on the Uniform CPA Examination be accepted.

Petition for: Three-year limited license to practice veterinary medicine under Section 6704(6) of the Education Law.
Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.
Applicable Guidelines: Section 6704(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinarian in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinarian to practice in New York State if all other licensure requirements are satisfied.

ACTION: The Department shall issue a limited license for a maximum of three years to practice veterinary medicine in New York State to each applicant, conditional upon Approval by the Department of all documentation needed to verify satisfaction of all veterinary medicine licensure requirements other than citizenship. The limited license may be renewed upon the lawful submission of an application for an extension of not more than one year, at the discretion of the Department.

MEDICINE
Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
