Indigenous Education Statement of Policy and Action - Department staff and members of the Commissioner's Advisory Council for Indigenous Education will present an update to the Board of Regents 1975 Indigenous Education Statement of Policy and Action for consideration of the Board of Regents. We plan to bring this back to the Board in November for endorsement. Empowering and Deepening Indigenous Youth Service - Department staff and Indigenous educators will present information on the Empowering and Deepening Indigenous Youth Service Grants. Proposed Amendment of Sections 121.1, 121.4, and 121.5 of the Regulations of the Commissioner of Education Relating to the National Institute for Standards and Technology (NIST) Cybersecurity Framework and Data Retention Policies - Department staff will present a proposed regulatory amendment to sections 121.1, 121.4, and 121.5 of the Commissioner’s regulations to update reference to the National Institute of Standards Technology (NIST) Cybersecurity Framework (CSF) to the most current version of the Framework (version 2.0). Additionally, the Department proposes to remove reference to an outdated data retention policy.

Proposed Amendment to Paragraph (8) of Subdivision (a) of Section 63.6 of the Regulations of the Commissioner of Education Relating to the Transferring of Prescriptions by Pharmacists - Department staff will present, for discussion and emergency action, a proposed amendment to section 63.6(a)(8) of the Regulations of the Commissioner of Education relating to pharmacies transferring prescriptions to other pharmacies. Presently, the regulations limit transfers to “one refill at a time”, which is more restrictive than the regulations in most other states, where pharmacists are generally permitted to transfer the entire prescription, including all remaining refills in one transaction. The proposed amendment will permit the transfer of an entire prescription, align New York with national standards, streamline the transfer process, improve patient access to medications, and significantly reduce the administrative burden on pharmacies, pharmacists, and prescribers, all which are particularly important following the recent closure of all New York’s Rite Aids. |

Proposed Amendment of Section 200.5 of the Regulations of the Commissioner of Education Relating to Special Education Due Process Hearings - Department staff will present the proposed amendment of Commissioner’s regulations to clarify that parents of students parentally-placed in nonpublic schools do not have the right to file a due process complaint regarding a dispute over the rate at which a provider shall be reimbursed if a school district did not provide services in an individualized education services plan and the parent unilaterally obtained such services. |
