SUMMARY:

On April 29, 2003, the Board of Regents voted to return the proposed charter for the Bedford Stuyvesant Preparatory Charter School for Excellence to the Board of Trustees of the State University of New York ("the Board of Trustees") for reconsideration based upon concerns about the legality of a single-sex school for boys in the absence of a corresponding single-sex school for girls. On May 21, 2003, the Board of Trustees resubmitted the proposed charter without modifications. The Board of Regents may either approve the resubmitted proposed charter or take no action. There is no statutory provision for the denial of the proposed charter. The concerns about the legality of a single-sex school for boys in the absence of a corresponding single-sex school for girls remain. If the Board of Regents takes no action with respect to the resubmitted proposed charter, this will have the effect of the proposed charter being deemed approved by operation of law on June 20, 2003.

VOTED: That the Board of Regents take no action on the following proposed charter:
