Procedural History
Section 6506(5) 
of the Education Law and Part 24.7 of the Rules of the Board of Regents 
authorizes the Regents to waive education, experience and examination 
requirements for a professional license as well as confer the degree Doctor of 
Medicine. 
Background Information
There are 23 
licensing petitions and 22 requests for the conferral of the degree Doctor of 
Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the 
Committee on the Professions’ recommendations will be effective December 5, 
2006.

Statement:  The petitioners listed below are all 
graduates of professionally accredited architecture programs who have applied 
for licensure in 
            
Prior to 1983, certain states did not require the Equivalency Examination 
(EE) or the Qualifying Test (QT) if a candidate had a degree from an accredited 
architecture program, and granted licensure upon passage of the Professional 
Examination (PE).  Prior to 1975, 
most states recognized the Examination Syllabus (ES).  The petitioners passed either the 
national Professional Examination (PE) given prior to 1983, or portions of the 
national Examination Syllabus (ES) given prior to 1975.  Prior to 1983, 
            
Section 7304(4) of Education Law and Section 69.3 of the Commissioner’s 
Regulations require for endorsement that “… an architect licensed in another 
state or jurisdiction as the result of successful completion of only the 
professional examination in use before 1983 may be granted licensure upon 
presentation of evidence of two years of work experience of a grade and 
character satisfactory to the State Board for Architecture and passage of a 
practical examination satisfactory to the State Board for Architecture 
…”
            
Each petitioner satisfied the examination requirement in his/her initial 
state of licensure and has extensive professional practice satisfactory to the 
State Board.  Since the above 
information illustrates evidence of competence within the profession, and in 
lieu of the practical examination, the Executive Secretary of the State Board 
for Architecture recommends that the examination requirement be considered 
satisfied and each applicant’s licensure in another state be accepted for 
endorsement in New York State.

of Problem:   Ms. DeMicco 
originally received conditional credit for passing the paper-based Auditing (AUD) and Law and Professional 
Responsibility (LPR) sections of the examination in November 2002.  For applicants receiving conditional 
credit at that time, Commissioner's 
Regulations required that the applicant pass all parts of the Uniform CPA 
examination within 36 months.  
She subsequently passed the computer-based Regulation (REG) 
section in August 2004.  Ms. DeMicco 
needed to pass the fourth section, Financial Accounting & Reporting (FAR), 
by November 2005 to retain credit for the two sections she passed in November 
2002.  In passing the Financial 
Accounting & Reporting section during July 2006, Ms. DeMicco needed eight 
additional months beyond the 36-month requirement provided in the regulations to 
pass all sections of the Uniform CPA Examination.
            
Ms. DeMicco experienced technical difficulties with the computer 
equipment when she sat for the final section she needed to pass during the 
November 2005 administration of the examination.  There was a 
delay in Ms. DeMicco receiving an acknowledgement that there were technical 
issues at that test site which resulted in the test site being closed after the 
November 2005 administration of the examination.  Because Ms. DeMicco had now reached the 
end of the 36-month conditioning, she delayed sitting the examination again 
until she was able to clarify whether or not she would lose credit for her 
previous sections.  Ms. DeMicco then 
scheduled her retest for July 2006 and passed the FAR section.   Had Ms. DeMicco not experienced 
technical difficulties at the examination site in November 2005, it is likely 
that she would have been successful on the examination and would not have 
exceeded the 36-month conditional credit period.
            
As the technical difficulties were beyond Ms. DeMicco’s control, the 
Executive Secretary for the State Board for Accountancy supports her request to 
waive the 36-month requirement to pass all four parts of the Uniform CPA 
Examination.

18-month period.  Ms. Katari 
originally received conditional credit for passing the computer-based Auditing 
and Attestation (AUD) section of the examination on October 13, 2004. She 
subsequently passed the computer-based Regulation (REG) and Business Environment 
& Concepts (BEC) sections, respectively, on February 26 and 27, 2006.  Ms. Katari needed to pass the fourth 
section, Financial Accounting & Reporting (FAR), by April 13, 2006 to retain 
credit for the AUD section she passed in October 2004. She scheduled for and 
passed the FAR section on May 25, 2006. 
            
Ms. Katari was diagnosed with a chronic medical condition in March 2005 
that impaired her ability to prepare and sit for the CPA exam, causing her to 
miss the conditioning requirements by 1.5 months.  
            
Based on the strength of the documentation provided by Ms. Katari’s 
physician, the Executive Secretary of the 
State Board for Public Accountancy supports her request to waive the 
18-month requirement to pass all four parts of the Uniform CPA 
Examination.

Regulations required that the applicant pass all parts of the Uniform CPA 
examination within 36 months. He subsequently passed the computer-based 
Regulation (REG) section on February 27, 2006. Mr. Tedawes needed to pass the 
fourth section, Financial Accounting & Reporting (FAR), by May 31, 2006 to 
retain credit for the two sections he passed in May 2003.
            
Mr. Tedawes scheduled to take the FAR section on August 31, 2005, the 
last day of the July/August testing window. Unfortunately, technical 
difficulties at the 
            
Mr. Tedawes sat again for the FAR section of the exam in February 2006 
and May 2006, before passing the FAR section in August 2006.  This passing date exceeded the 36-month 
conditional credit period required by Commissioner’s Regulations by four 
months.  Had Mr. Tedawes not been 
prevented by technical failures from sitting for the FAR section during the 
July/August 2005 testing window, it is likely that he would not have exceeded 
the 36-month conditional credit period.
            
As the technical difficulties Mr. Tedawes experienced were beyond his 
control, the Executive Secretary for the State Board for Public Accountancy

Tilis needed to pass the fourth section, Business Environment & Concepts

Mr. Tilis’ attempts to pass BEC within the 18-month time period were 
complicated by an administrative error encountered with the examination vendor, 
Prometric, in May 2006.  On May 23, 
2006, Mr. Tilis appeared for a previously scheduled appointment to take the BEC 
section of the examination and was told by test center staff that they had lost 
his scheduling record due to computer system difficulties.  Mr. Tilis later spoke with 
representatives of the Department’s examination administrator, CPA Examination 
Services, who confirmed that a mistake had been made.  The second quarter testing window closed 
on May 31, 2006 and the first available date to reschedule an appointment was 
July 1, 2006. Mr. Tilis was able to schedule his appointment for July 10, 2006, 
at which time he successfully completed the BEC section of the 
examination.
            
Given the administrative errors encountered by Mr. Tilis at the test 
center, the Executive Secretary of the 
State Board for Public Accountancy supports his request that the 
Committee on the Professions be petitioned to waive the 18-month requirement to 
pass all four parts of the Uniform CPA Examination.

Statement of Problem:  Dr. Sievert completed his medical 
studies and received his degree from the Johannes Gutenberg University of Mainz 
in 1979. Dr. Sievert obtained a full medical license with specialist 
registration from the General Medical Council in the 
            
At its September 6, 2006 meeting, the Committee on the Professions 
determined that Dr. Sievert had satisfied the three-year postgraduate hospital 
training requirement, based, in part, on his specialty certificate in internal 
medicine. Based upon a further review of the documentation submitted, the 
Executive Secretary of the State Board for Medicine recommends that Dr. 
Sievert’s German postgraduate training and German specialty certificates in 
cardiology and angiology be used to fulfill the required  three years of approved postgraduate 
training.

| Sections 60.1 and 60.5 of the Commissioner’s Regulations for endorsement of a foreign license require: |  | 
| (1) Six years of postsecondary education, including at least 32 months of medical education. | (a)

The applicable requirements of Section 3.57 of the Rules of the Board of 
Regents require completion of a medical education program in a foreign medical 
school satisfactory to the Department which does not grant the degree Doctor of 
Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as 
determined by the Department in accordance with the policy of the Board of 
Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at 
medical schools in the United States satisfactory to, or registered by, the
