THREE-YEAR LIMITED LICENSE IN PHARMACY

 

Petition for: Three-year limited license to practice pharmacy under Section 6805(6) of the Education Law.

 

Statement of Problem:  The applicants listed below have met the education, examination and experience requirements for licensure as a pharmacist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant also has a pending application for full pharmacy licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

 

Applicable Guidelines:  Section 6805(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a pharmacist in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien pharmacist to practice in New York State if all other licensure requirements are satisfied.

Petition for:  Acceptance of experience for nurse practitioner certification under alternative criteria.

 

Statement of Problem:  Ms. Tourtelot-Smith holds New York State certification as a nurse practitioner in family health issued on the basis of completion of the Family Health Nurse Practitioner Program at SUNY Upstate Medical Center, Syracuse, New York.  She is petitioning for nurse practitioner certification in the additional specialty area of psychiatry under alternative criteria.

 

          For certification in an additional specialty area under alternative criteria, Commissioner's Regulations require, in addition to appropriate education, evidence of one thousand hours of clinical practice in the specialty area in which the additional certification is sought in a health care facility licensed pursuant to Article 28 of the Public Health Law.   Ms. Tourtelot-Smith is presenting evidence of over one thousand hours of experience as a nurse practitioner in psychiatry at the Central New York Psychiatric Center at Midstate Correctional Facility, Marcy, New York.  She asks that her experience be accepted as the substantial equivalent of experience in an Article 28 facility.  The Executive Secretary of the State Board for Nursing supports her request.

 

APPLICABLE REQUIREMENTS:

Section 64.4 of the Regulations of the Commissioner of Education requires under alternative criteria:

 

(1)  Sixty hours of continuing education in the specialty area in which certification is sought. 

(1)  Sixty hours of continuing education in the area of psychiatry. 


 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

 

Section 64.4 of the Regulations of the Commissioner of Education requires under alternative criteria:

 

(2) One thousand hours of clinical practice in the specialty area in which additional certification is sought in a health care facility licensed pursuant to Article 28 of the Public Health Law.

(2) More than one thousand hours of experience as a nurse practitioner in psychiatry at the Central New York Psychiatric Center at Midstate Correctional Facility, Marcy, New York from December 2002 through December 2003. 

(3) Completion of an acceptable course of at least three semester hours or the equivalent in pharmacology. 

3) Completed three semester hours in pharmacology as part of her Family Health Nurse Practitioner program at SUNY Upstate Medical Center, Syracuse, New York, 1999.

 

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Nursing, recommends that the applicant’s petition for acceptance of one thousand hours of experience as a nurse practitioner at the Central New York Psychiatric Center at Midstate Correctional Facility, Marcy, New York be considered the substantial equivalent of experience in a health care facility licensed pursuant to Article 28 of the New York State Public Health Law to satisfy the requirement for nurse practitioner certification under alternative criteria be approved. 

 

THREE YEAR LIMITED LICENSE IN DENTISTRY

 

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

 

Statement of Problem: The applicants listed below have satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

 

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:  Acceptance of education as the substantial equivalent of a registered program, acceptance of preprofessional education, and waiver of the requirements pertaining to acceptability of licensing examinations. 

 

Statement of Problem:  Dr. Rodgers completed a chiropractic program in the United States, which was not accredited by the Council on Chiropractic Education (CCE), an accrediting organization acceptable to the Department, at the time of his graduation. He completed unaccredited chiropractic studies in 1974 at Columbia Institute of Chiropractic in New York City.  The chiropractic program at the Manhattan campus, which he completed, was not nationally accredited nor was it registered by the New York State Education Department. 

 

The Department recommends that, as an alternative to the regulatory requirements, graduates of unaccredited chiropractic programs be allowed to complete a special course of study of at least 24 semester credit hours in chiropractic that is designed by a recognized chiropractic college to include any program deficiencies.   Dr. Rodgers has now presented 30 postgraduate transfer semester credits awarded by New York Chiropractic College on May 26, 2004.  The Dean of Academic Affairs of New York Chiropractic College has stated that Dr. Rodgers's combination of studies represents the equivalent of the clinical proficiency and level of knowledge that is expected of current New York Chiropractic College graduates.

 

In view of this additional study, equivalent to approximately a year of professional study, and New York Chiropractic College’s attestation as to Dr. Rodgers’s level of knowledge and clinical competency, staff believe that the applicant’s combined education represents the equivalent of a professional program registered by the Department. 

 

Also, Dr. Rodgers did not complete the required sixty semester credits of preprofessional education prior to entry into chiropractic studies.  Instead, he had 50.5 credits and later completed additional preprofessional college studies, including the required coursework in the basic sciences.  Section 24.3(a) of the Commissioner's Regulations allows the Committee on the Professions (COP) to accept up to thirty semester credits of preprofessional study taken after entry into the professional program and to waive up to six semester hours of preprofessional education.  Department staff support such action by the COP to satisfy the preprofessional education requirement.

 

In addition, Dr. Rodgers took and passed the National Board of Chiropractic Examiners (NBCE) Part I and Part II examinations in 1973 and 1974.  Commissioner’s Regulations permit acceptance of passing grades on the NBCE examinations administered subsequent to September 1, 1977.  The State Board for Chiropractic has recommended, since April 1992, that all NBCE Part I and Part II passing scores be accepted regardless of the date of administration as applicants passing the examination prior to 1977 usually have extensive licensed professional practice.  Dr. Rodgers has documented professional chiropractic practice since October 1974.  Staff recommend that the licensing examinations be accepted and that Dr. Rodgers’ New Jersey license be accepted for endorsement in New York State. 

 

APPLICABLE REQUIREMENTS:

Sections 6554 and 6507 of the Education Law require:

 

(1) Two years of satisfactory preprofessional college study.

(2) University of Hartford, Hartford, Connecticut, 50.5 semester credits, 1969-1970; New York Institute of Technology, Old Westbury, New York, B.S. in life science, 1974-1975; University of Bridgeport, Connecticut, M.S. in biology, 1979.

APPLICABLE REQUIREMENTS:

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Chiropractic, recommends that the applicant’s preprofessional and professional education be considered satisfied and that the combination of examinations he completed in conjunction with other qualifications be accepted to satisfy the licensing examination requirement.

Petition for:  Three-year limited license to practice veterinary medicine under Section 6704(6) of the Education Law.

 

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

 

Applicable Guidelines: Section 6704(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinarian in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinarian to practice in New York State if all other licensure requirements are satisfied.

MEDICINE

 

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

 

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

 

          The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department.  Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
