Petition for:  Acceptance of education.

 

Statement of Problem:  Ms. Abayeva completed a three-year professional nursing program leading to a diploma of Medical Nurse in Children's Institutions at the Tashkent City Medical Uchilische named for P. F. Borovsky in Tashkent, Uzbekistan in June 1980.  The diploma awarded to graduates of the school’s general nursing program is Medical Nurse.  Ms. Abayeva asks that her education be accepted as satisfying the educational requirements for licensure.

 

          Section 6905 of New York State Education Law requires that applicants for nursing licensure in registered professional nursing must have received a diploma or degree in general nursing.  Ms. Abayeva’s school of nursing sent the Department copies of its nursing curricula, listing courses and hours for both its general nursing program and its medical nurse in children's institutions nursing program.  Department staff have reviewed the specific courses for both programs and have determined that the general nursing study in both programs is substantially the same. The medical nurse in children's institutions program requires more total hours than the general program and includes additional hours in pediatric courses.  Staff recommend that her nursing education be considered equivalent to the general nursing education required in Commissioner's Regulations.

Section 6905 of New York State Education Law and Section 64.1 of the Regulations of the Commissioner of Education require:

 

  (1)  Graduation from a general nursing program of at least two academic years in a country outside the United States that is satisfactory to the Department and recognized by the licensing authorities of that country as being preparation for practice as a registered professional nurse.

Petition for:  Acceptance of residency in lieu of Part III of the licensing examination.

 

Statement of Problem:  In 1993, Dr. Lalla graduated from the Aristotle University School of Dentistry in Greece and came to the United States to study at Columbia University in 1994.  After earning a Master of Science degree in Periodontics in 1997, Dr. Lalla enrolled in the Doctor of Dental Surgery degree program at Columbia University and was awarded the D.D.S. degree in May 2000. She satisfies the preprofessional and professional education requirements for licensure in dentistry.  In 1999, Dr. Lalla passed Parts I and II of the examinations of the National Board of Dental Examiners.  In 2001 and 2002, she passed three of the four parts of the Northeast Regional Board Examination (Part III of the licensing examination).

 

Commissioner's Regulations allow substitution of an acceptable residency program in lieu of Part III of the licensing examination if the residency was completed within two years prior to application for licensure in New York State. The residency program must be at least one year in length in a hospital or dental facility accredited by the Commission on Dental Accreditation (CDA) of the American Dental Association. Dr. Lalla completed a three-year residency program in periodontics at Columbia University School of Dental and Oral Surgery in 1997. The Director of the Division of Periodontics at the time Dr. Lalla was in the residency confirms her successful completion of the residency. Ms. Lalla’s residency program satisfies the clinical requirements stated in Commissioner’s Regulations, but she did not complete the program within the specified two-year period prior to applying for licensure.

 

The Dean of the Columbia University School of Dental and Oral Surgery states that Dr. Lalla joined the faculty of Columbia University as an Instructor in 1997, and was promoted to Assistant Professor in 2000 and to Associate Professor in 2003.  He also reports that Dr. Lalla is the principal investigator on two grants from the National Institute of Health/National Institute of Dental and Craniofacial Research and is a co-investigator on a third grant.  She has published papers in peer-reviewed medical and dental journals and been invited to speak at national and international dental and medical research meetings. 

 

The Dean reports that Dr. Lalla has excellent clinical skills and is a recognized expert in the area of periodontal surgery and implantology.

 

          Dr. Lalla asks that her residency in periodontics, completed in 1997, be accepted to satisfy the residency requirement in lieu of Part III of the licensing examination.  Based on the applicant's individual situation, the Executive Secretary of the State Board for Dentistry supports her request.

Petition for:  Acceptance of education.

 

Statement of Problem:  Dr. O'Connor did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. 

 

          Dr. O'Connor was a resident in the 1984-85 Advanced Education in General Dentistry (AEGD) program at Eastman Dental Center, University of Rochester.  Dr. Hans Malmstrom, Program Director of the AEGD Program, writes that during Dr. O'Connor's residency, he played an important role in developing the two-year general dentistry program currently offered by the Eastman Dental Center and achieved the same level of clinical and didactic competence expected of a graduate of the current two-year program.

 

          In October 1985, Dr. O'Connor returned to Queen's University of Belfast and in December 1990 earned the Bachelor of Medicine, Bachelor of Surgery, and Bachelor of Obstetrics degrees.   In July 1998, he entered a residency in oral and maxillofacial surgery at the University of Washington, Seattle, Washington, and successfully completed the residency in June 2002.

 

          Dr. O'Connor asks that his one-year AEGD program, his subsequent degree in medicine, and his residency in oral-maxillofacial surgery at the University of Washington be accepted as the substantial equivalent of the two academic years of study in an accredited dental school program required of graduates of unregistered or unaccredited dental schools.  Based on the applicant's unique qualifications, the Executive Secretary of the State Board for Dentistry supports his petition.

THREE-YEAR LIMITED LICENSE IN DENTAL HYGIENE

 

Petition for: Three-year limited license to practice Dental Hygiene under Section 6609(6) of the Education Law.

 

Statement of Problem: The applicant listed below has satisfied the education and examination requirements for licensure as a dental hygienist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          The applicant has an opportunity to practice dental hygiene in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6609(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

 

Applicable Guidelines: Section 6609(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dental hygienist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dental hygienist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:  Waiver of New York State practical examination requirement.

 

Statement of Problem:  Dr. Labas has not passed a satisfactory practical examination, as required for licensure, either by the endorsement or examination route.  New York State accepts a passing score on Part III of the examination of the National Board of Examiners in Optometry (NBEO) to satisfy the practical examination requirement.  The NBEO practical examination was not available when Dr. Labas was licensed in Illinois in 1992. 

 

Dr. Labas has documented over ten years of licensed practice during which time she was certified in the use of diagnostic pharmaceutical agents and therapeutic pharmaceutical agents. 

 

Based on Dr. Labas' demonstration of clinical skills through her years of hands-on licensed practice and her success on other professional examinations, the Executive Secretary of the State Board for Optometry recommends that the requirement for a satisfactory practical examination (NBEO Part III) be waived.

Section 7104 of the Education Law and Part 66 of the Regulations of the Commissioner of Education require:

 

(1) Approved Doctor of Optometry degree or the equivalent earned on completion of an acceptable optometry program.

an optometry license issued by another jurisdiction with at least five years of professional practice of optometry following initial licensure and within the 10 years immediately preceding application for licensure by endorsement.

Petition for:  Acceptance of pre-professional education and waiver of the requirements pertaining to acceptability of licensing examinations. 

 

Statement of Problem:  Dr. Nusbaum completed the required preprofessional education coursework for licensure except for a college-level course in organic chemistry.  However, he later took this course after entry into his chiropractic studies at National College of Chiropractic in Illinois. Section 24.3(a) of the Commissioner's Regulations allows the Committee on the Professions (COP) to accept study taken after entry into the professional program to satisfy preprofessional education requirements. Department staff support such action by the COP.

 

Also, Dr. Nusbaum took and passed the National Board of Chiropractic Examiners (NBCE) Parts I and II examinations in 1971 and 1973.  Commissioner’s Regulations permit acceptance of passing grades on the NBCE examinations administered subsequent to September 1, 1977.  The State Board for Chiropractic has recommended, since April 1992, that all NBCE Part I and Part II passing scores be accepted regardless of the date of administration as applicants passing the examination prior to 1977 usually have extensive licensed professional practice.  Dr. Nusbaum has documented professional chiropractic practice since 1973.  Staff recommend that the licensing examinations be accepted and that Dr. Nusbaum's Virginia licensure be accepted for endorsement in New York State. 

 

 

APPLICABLE REQUIREMENTS:

Sections 6554 and 6507 of the Education Law require:

 

(1) Two years of satisfactory preprofessional college study.

THREE-YEAR LIMITED LICENSE IN VETERINARY MEDICINE

 

Petition for:  Three-year limited license to practice veterinary medicine under Section 6704(6) of the Education Law.

 

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

 

Applicable Guidelines: Section 6704(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinarian in New York State and allows the Board of Regents to grant a one-time, three-year waiver (plus an extension of not more than one year) for an alien veterinarian to practice in New York State if all other licensure requirements are satisfied.

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations.

 

Statement of ProblemDr. White-Weithers graduated from an accredited veterinary medicine program in the United States in 1989.  The applicant was licensed in Alabama in 1989 on the basis of national examinations acceptable in Alabama. She had also passed the December 1988 Clinical Competency Test (CCT).  In 2000, she was licensed in Texas after passing that state’s jurisprudence examination.  However, she has not achieved a score satisfactory to New York State on the National Board Examination (NBE).  Dr. White-Weithers retook the NBE in December 1990 and obtained a score of 74, one point below the minimum standard of 75.00 required by New York State.  Dr. White-Weithers has documented completion of an internship in small animal medicine at Tuskegee University, subsequent training and a passing score on the board certification examination of the American College of Veterinary Dermatology, and satisfactory professional practice in veterinary medicine. 

 

          Section 59.6(c) of the Regulations of the Commissioner of Education regarding licensure by endorsement stipulates that applicants must not have “attempted unsuccessfully a licensing examination used by the State of New York … unless such applicant has later passed a comparable licensing examination.”  Dr. White-Weithers did not achieve a score acceptable to New York State on the NBE – a licensing examination used by this state.  Therefore, according to this regulation, she would not qualify for licensure by endorsement unless she had passed the NBE or a comparable licensing examination. 

 

However, the Executive Secretary of the State Board for Veterinary Medicine recommends that the combination of Dr. White-Weithers’ more than ten years of satisfactory professional practice in Alabama and Texas, including her seven years as Assistant Professor of Clinical Sciences in the School of Veterinary Medicine at Tuskegee University, her certification by the American Board of Veterinary Dermatology, and her performance on licensing examinations satisfactory to Alabama provide sufficient evidence of her competence

to practice in New York State. Therefore, he recommends that the
applicant’s Alabama license be accepted for endorsement in New York State, waiving the specific requirement of a passing examination score on the NBE examination. 

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 6704 of the Education Law and Part 62 of the Regulations of the Commissioner of Education require:

 

(1) Completion of six years of preprofessional and professional postsecondary studies satisfactory to the Department, including satisfactory clinical education, and graduation with a satisfactory degree in veterinary medicine.

(2) Acceptable scores on satisfactory licensing examinations or passing scores on an acceptable state licensing examination not in use in New York State and at least two years’ satisfactory professional experience following licensure.

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Veterinary Medicine, recommends that the NBE examination requirement be waived and the applicant’s Alabama license be endorsed.

Petition for:  Endorsement of his Australian medical license and acceptance of hospital training completed in Australia and the United Kingdom as the substantial equivalent of three years of ACGME-accredited postgraduate hospital training.

 

Statement of Problem:  Commissioner’s Regulations allow endorsement of an applicant’s license from another jurisdiction if appropriate requirements are met. One of the requirements is the satisfactory passing of an acceptable licensing examination.  At the present time, New York State requires acceptable scores on Steps 1, 2, and 3 of the United States Medical Licensing Examination (USMLE). Dr. Ward has passed Steps 1 and 2 but has not taken Step 3.  Dr. Ward requests that his medical license obtained by examination in Australia be endorsed.  The Executive Secretary for the State Board for Medicine recommends that the licensing examination he completed in Australia be accepted to satisfy New York State's licensing examination requirement.

           

          Commissioner's Regulations require Dr. Ward to complete 3 years of graduate hospital training accredited by the American Council on Graduate Medical Education (ACGME). After finishing his medical studies at the University of Newcastle, Newcastle, New South Wales, Dr. Ward completed general practice training accredited by The Royal Australian College of General Practitioners, Victoria, Australia, from February 2, 1997 to January 31, 2000.  In August 2004, Dr. Ward began the Oxfordshire Postgraduate General Practice Training Education program in Oxford, England, and trained there until February 2004.  He passed the required Summative Assessment and was awarded a Certificate of Equivalent Experience from the Joint Committee on Postgraduate Training for General Practice. Dr. Ward requests that his hospital training in Australia and the United Kingdom be considered the substantial equivalent of three years of ACGME-accredited postgraduate hospital training. The Executive Secretary of the State Board for Medicine supports this request.

MEDICINE

 

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

 

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

 

          The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department.  Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
