SUMMARY:

 

Attached are summary recommendations with respect to charter applications. A total of 19 charter actions are recommended involving 20 institutions, including 2 libraries, 1 historical society, 10 nonpublic schools, 5 chartered postsecondary institutions and 1 not-for-profit corporation.

 

I recommend that the Regents approve each application in accordance with the recommendations contained in the respective summaries.

ROELIFF JANSEN COMMUNITY LIBRARY ASSOCIATION

 

Hillsdale, Columbia County

 

The board of trustees has petitioned the Board of Regents to form a corporation to provide public library services to the residents of the towns of Hillsdale, Ancram and Copake in Columbia County, New York. The Office of Cultural Education recommends that an absolute charter in the first instance be granted.

Lyons, Wayne County

 

A provisional charter was granted to this corporation by action of the Board of Regents on June 24, 1955 to operate a free public library. Such provisional charter was made absolute by Regents action on September 30, 1960 and amended by Regents action on September 15, 1995. The board of trustees has applied for an amendment to the absolute charter to change the corporate name to “Lyons Public Library.” The Office of Cultural Education recommends that the absolute charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents on April 27, 1999 to operate a day care and a nursery school. The board of trustees has applied for an amendment to the provisional charter to change the corporate address to 15 Dutch Street, New York, New York 10038; to add authority to also operate a toddler program for two-year-olds, a grade one elementary school, an after-school care program for children from five to six years of age and a summer program and, as so amended, be extended. The Office of Nonpublic School Services recommends that the provisional charter be amended accordingly and, as so amended, extended for a period of three years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

The Office of Nonpublic School Services recommends that the provisional charter be extended for three years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

A provisional charter was granted to this corporation by action of the Board of Regents on July 18, 2002 to operate a center-based nursery school, a kindergarten and a grade one through six elementary school. Such provisional charter was amended by Regents action on March 25, 2003, and as so amended, extended. The board of trustees has applied for an amendment to the provisional charter to change the location of the school to 570 West Walnut Street, Long Beach, New York 11561 and as so amended, for an extension of the charter. The Office of Nonpublic School Services recommends that the provisional charter be amended accordingly and, as so amended, extended for a period of three years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

THE HANNAH SENESH COMMUNITY DAY SCHOOL and THE COMMITTEE TO FORM THE HANNAH SENECH SCHOOL, INC.

 

Brooklyn, Kings County

 

The board of trustees and the board of directors have petitioned the Board of Regents, pursuant to Education Law §223, for an order of consolidation of The Hannah Senesh Community Day School and The Committee to Form the Hannah Senech School, Inc. The Hannah Senesh Community Day School was incorporated by the Board of Regents with the issuance of a provisional charter on April 24, 2001. The Committee to Form the Hannah Senech School, Inc. was incorporated under §402 of the Not-For-Profit Corporation Law  (NPCL) on November 21, 1997 with the consent of the Commissioner of Education. Upon the effective date of the consolidation of The Hannah Senesh Community Day School and The Committee to Form the Hannah Senech School, Inc., The Hannah Senesh Community Day School will assume all the assets, liabilities and responsibilities of both organizations. The consolidated corporation will operate under the provisional charter granted to The Hannah Senesh Community Day School. The board of trustees also requests that the provisional charter be amended to add the following purposes: to promote the welfare of children in the home, school and community; to raise the standards of home life, and to bring into closer relation the home and the school, making it possible for parents and teachers to cooperate intelligently in the educational training of children. The Office of Nonpublic School
Services recommends that an order of consolidation of The Hannah Senesh Day School and The Committee to Form the Hannah Senech School, Inc., be granted, with The Hannah Senesh Community Day School as the surviving corporation and that the provisional charter be amended accordingly.

A provisional charter was granted to this corporation by action of the Board of Regents on December 20, 1946 to form a corporation to further the education and training of licensed physicians. Such provisional charter was made absolute by Regents action on October 26, 1951 and amended by Regents action on March 29, 1974, October 19, 1978 and November 20, 1992. The board of trustees has applied for an amendment to the absolute charter to change the purposes to also include the training and certification as psychoanalysts of persons who have earned a Master’s Degree or its equivalent in other than a mental health profession. The Office of the Professions recommends that the absolute charter be amended accordingly.

ITHACA COLLEGE

 

Ithaca, Tompkins County

 

An absolute charter in the first instance was granted to this corporation by action of the Board of Regents under the corporate name “The Ithaca Conservatory and Affiliated Schools” on January 21, 1926 to establish an institution of higher education providing instruction in all branches of music, elocution, physical education and selected fine arts. Such absolute charter was amended by Regents action on March 19, 1931 to change the corporate name to “Ithaca College,” February 19, 1943, September 15, 1950, May 24, 1957, April 25, 1958, October 27, 1972, January 17, 1984, September 23, 1994 and February 8, 2000.  The board of trustees has applied for an amendment to the absolute charter to add authority for the College to confer the degree of Doctor of Physical Therapy (D.P.T.)  The Office of Higher Education recommends that the absolute charter be amended accordingly.

Such provisional charter was extended by Regents action on January 21, 1987, September 24, 1993 and June 8, 1999. The board of trustees has applied for an extension to the provisional charter. The Office of the Professions recommends that the provisional charter be extended for five years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the requirements for an absolute charter.

A provisional charter was granted to this corporation by action of the Board of Regents on May 21, 1993 to establish and maintain an institution of learning for the purpose of offering instruction, training and the opportunity for research in the theory and practice of psychoanalysis, emphasizing the method and insights of Heinz Kohut and other major self psychological theorists. Such provisional charter was extended by Regents action on July 16, 1999. The board of trustees has applied for an extension to the provisional charter. The Office of the Professions recommends that the provisional charter be extended for a period of five years to allow the corporation additional time to develop its programs and otherwise demonstrate that it can meet the standards for an absolute charter.

Such provisional charter was extended by Regents action on February 3, 1999. The board of trustees has applied for an extension of their provisional charter.
