Report of Regents Higher Education Committee to The Board of Regents

The Higher Education Committee held its scheduled meeting on June 9, 2025. All members were present. Chancellor Young, Regent Roger Tilles, Regent Christine D. Cea, Regent Susan W. Mittler, Regent Shino Tanikawa, Regent Patrick A. Mannion, Regent Brian Krist, Regent Keith B. Wiley, and Regent Felicia Thomas-Williams also attended the meeting but did not vote on any action.

ACTION ITEMS

Northeastern University and Marymount Manhattan College Merger [HE (A) 1] - Department staff presented recommendations regarding actions related to a merger between Marymount Manhattan College and Northeastern University, including issuing a charter to Northeastern – New York City, amending Marymount Manhattan College’s charter, and authorizing Northeastern – New York City to award degrees.

The Committee recommends that the Board of Regents grant Northeastern – New York City a five-year provisional charter, to become absolute upon merger with Marymount Manhattan College.

The Committee recommends that the Board of Regents approve an amendment to the charter of Marymount Manhattan College, to make Northeastern – New York City the sole member of Marymount Manhattan College with enumerated reserved powers, in anticipation of a merger of these two corporations.

The Committee recommends that the Board of Regents approve a merger of Marymount Manhattan College and Northeastern – New York City, with Northeastern – New York City being the surviving corporation, to be effective following notification to the Department of the receipt of any required approvals from the United States Department of Education.

The Committee recommends that the Board of Regents permanently authorize Northeastern – New York City to offer programs leading to postsecondary degrees, to be effective upon the consummation of the merger of Marymount Manhattan College and Northeastern – New York City.

Proposed Amendment of Sections 80-2.9, 80-4.3, and 80-5.18 of the Regulations of the Commissioner of Education Relating to Flexibilities for the Supplementary Certificate and Supplementary Bilingual Education Extension Requirements in Response to the Influx of Recently Arrived and Asylum-Seeking Students [HE (D) 3] - Department staff presented a proposed regulatory amendment to extend flexibilities for the supplementary certificate and supplementary bilingual education extension requirements in response to the influx of recently arrived and asylum-seeking students. 

The Committee recommends that sections 80-2.9, 80-4.3, and 80-5.18 of the Regulations of the Commissioner of Education be amended, as submitted, effective June 10, 2025, as an emergency rule upon finding by the Board of Regents that such action is necessary for the preservation of the general welfare, in order to immediately continue flexibilities related to the requirements for the Supplementary certificate and Supplementary Bilingual Education extension to address staffing challenges due to the influx of recently arrived and asylum-seeking students.

MATTERS NOT REQUIRING BOARD ACTION

Proposed Technical Amendment of Section 52.21 of the Regulations of the Commissioner of Education Relating to Certification Examinations [HE (D) 1] - Department staff presented a proposed regulatory amendment to make technical amendments that would implement formerly proposed amendments related to certification examinations as intended.  

Proposed Amendment of Section 30-1.8 of the Rules of the Board of Regents Relating to Special Subject Tenure Areas [HE (D) 2] - Department staff presented a proposed regulatory amendment to make technical amendments that would implement formerly proposed amendments related to certification examinations as intended. 

Deputy Commissioner William Murphy reviewed the items on the Consent Agenda.

Committee
