Report of Regents P-12 Education Committee to The Board of Regents

Your P-12 Education Committee held its scheduled meeting on April 11, 2022. All members were present, with the exception of Regent Cottrell who was excused.

Renewal Recommendations for Charter Schools Authorized by the Board of Regents [P-12 (A) 1]

Your Committee recommends that the Board of Regents finds that Amani Public Charter School (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Amani Public Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2026.

Your Committee recommends That the Board of Regents finds that the Charter School of Inquiry (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of the Charter School of Inquiry and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2026.

Your Committee recommends that That the Board of Regents finds that New Visions Charter High School for Advanced Math and Science II: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of New Visions Charter High School for Advanced Math and Science II and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2027.

The motion passed.  There were no oppositions or abstentions.

SUNY Board of Trustees-authorized Charter School Dissolutions [P-12 (A) 2]

Your Committee recommends that the provisional charter of the ROC Achieve Charter School, located in the Rochester City School District, County of Monroe, State of New York, which was granted by the Board of Regents in January 2014, be, and the same hereby is, dissolved, that notice to such effect be given to the board of trustees of the Corporation and the State University of New York Trustees, and that the Board of Regents directs that any student records and/or any remaining assets of the Corporation be transferred, and that any funds remaining in the possession of the Corporation that can be attributed to public funding be distributed, to each school district having resident children served by the charter school in the last school year, in accordance with the provisions of Education Law §2851(2)(t), and that, in accordance with Education Law §220, the Corporation shall, within three (3) months of said dissolution, petition the supreme court in the judicial district where the principal office of the Corporation is or was located for an order directing such disposition.

Your Committee recommends that the provisional charter of the Heketi Community Charter School, located in NYC CSD 7, County of Bronx, State of New York, which was granted by the Board of Regents in December 2010, be, and the same hereby is, dissolved, that notice to such effect be given to the board of trustees of the Corporation and the State University of New York Trustees, and that the Board of Regents directs that any student records and/or any remaining assets of the Corporation be transferred, and that any funds remaining in the possession of the Corporation that can be attributed to public funding be distributed, to each school district having resident children served by the charter school in the last school year, in accordance with the provisions of Education Law §2851(2)(t), and that, in accordance with Education Law §220, the Corporation shall, within three (3) months of said dissolution, petition the supreme court in the judicial district where the principal office of the Corporation is or was located for an order directing such disposition.

Revision Recommendations for Charter Schools Authorized by the Board of Regents [P-12 (A) 3]

Your Committee recommends that the Board of Regents finds that: (1) the Key Collegiate Charter School meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the charter school can demonstrate the ability to operate in an educationally and fiscally sound manner; (3) granting the request to amend the charter is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of Article 56 of the Education Law; and (4) granting the request to amend the charter will have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the charter revision for Key Collegiate Charter School and amends the provisional charter accordingly.

Your Committee recommends that the Board of Regents finds that: (1) the South Bronx Early College Academy Charter School meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the charter school can demonstrate the ability to operate in an educationally and fiscally sound manner; (3) granting the request to amend the charter is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of Article 56 of the Education Law; and (4) granting the request to amend the charter will have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the charter revision for South Bronx Early College Academy Charter School and amends the provisional charter accordingly.

The motion passed.  There were no oppositions or abstentions.

Revision Recommendations for Charter Schools Authorized by the New York City Department of Education [P-12 (A) 4]

Your Committee recommends that the Board of Regents finds that Imagine Me Leadership Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the charter revision of Imagine Me Leadership Charter School and amends the provisional charter accordingly.

Your Committee recommends that the Board of Regents finds that Dr. Richard Izquierdo Health and Science Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Dr. Richard Izquierdo Health and Science Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2027.

Your Committee recommends that the Board of Regents finds that Ember Charter School for Mindful Education, Innovation and Transformation: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Ember Charter School for Mindful Education, Innovation and Transformation and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

Your Committee recommends that the Board of Regents finds that Growing Up Green Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Growing Up Green Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2027.

Your Committee recommends that the Board of Regents finds that Hebrew Language Academy Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Hebrew Language Academy Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

Your Committee recommends that the Board of Regents finds that New York French-American Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of New York French-American Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2025.

Your Committee recommends that the Board of Regents finds that Rochdale Early Advantage Charter School: (1) meets the requirements set out in Article 56 of the Education Law, and all other applicable laws, rules and regulations; (2) the applicant can demonstrate the ability to operate the school in an educationally and fiscally sound manner; (3) granting the application is likely to improve student learning and achievement and materially further the purposes set out in subdivision two of Section twenty-eight hundred fifty of this article; and (4) granting the application would have a significant educational benefit to the students expected to attend the charter school, and the Board of Regents therefore approves the renewal application of Rochdale Early Advantage Charter School and that a renewal charter be issued, and that its provisional charter be extended for a term up through and including June 30, 2027.

The motion passed. Regent Cashin abstained.

Your P-12 Education Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the oral report of the Committee's deliberations at its meeting on April 12, 2022.
