The Professional Practice Committee held its scheduled meeting on October 7, 2025. All members were present. Chancellor Lester W. Young, Regent Susan W. Mittler, Regent Aramina Vega Ferrer, Regent Shino Tanikawa, Regent Seema Rivera, and Regent Felicia Thomas-Williams, also attended the meeting, but did not vote on any action.

ACTION ITEMS

Professional Discipline Cases [PPC (A) 1 – 3]

The Committee recommends that the reports of the Regents Review Committees, including rulings, findings of fact, determinations as to guilt, and recommendations, by unanimous or majority vote, contained in those reports which have been distributed to you, be accepted in 4 cases.  In addition, the Committee recommends, upon the recommendation of the Committee on the Professions, that 32 consent order applications and 6 surrender applications be granted.

These recommendations are made following the review of 42 cases involving eight licensed practical nurses, eight registered professional nurses, four certified public accountants, two licensed practical nurses who are also registered professional nurses, two pharmacists, two registered professional nurses who are also nurse practitioners in Family Health, one certified public accountancy partnership, one certified public accountancy sole proprietorship, one certified to administer dental parenteral conscious sedation, one dentist, one domestic limited liability partnership, one landscape architect, one licensed clinical social worker, one licensed master social worker who is also a licensed clinical social worker, one marriage and family therapist, one non-resident pharmacy, and one veterinarian.

Proposed Amendment to Paragraph (8) of Subdivision (a) of Section 63.6 of the Regulations of the Commissioner of Education Relating to the Transferring of Prescriptions by Pharmacists [PPC (A) 1]
Department staff presented, for discussion and emergency action, a proposed amendment to section 63.6(a)(8) of the Regulations of the Commissioner of Education relating to pharmacies transferring prescriptions to other pharmacies. Presently, the regulations limit transfers to “one refill at a time”, which is more restrictive than the regulations in most other states, where pharmacists are generally permitted to transfer the entire prescription, including all remaining refills in one transaction. The proposed amendment will permit the transfer of an entire prescription, align New York with national standards, streamline the transfer process, improve patient access to medications, and significantly reduce the administrative burden on pharmacies, pharmacists, and prescribers, all which are particularly important following the recent closure of all Rite Aid stores in New York.

The Committee recommends that paragraph (8) of subdivision (a) of section 63.6 of the Regulations of the Commissioner of Education be amended, as submitted, effective October 7, 2025, as an emergency rule, upon the finding that such action is necessary for the preservation of the public health and general welfare to immediately require that pharmacists and pharmacies transfer a patient’s entire prescription, including all authorized refills.

The Professional Practice Committee recommends, and we move, that the Board of Regents act affirmatively upon each recommendation in the written report of the Committee's deliberations at its meeting on October 7, 2025.
