            The Board of Regents of The University of the State of New York held public sessions on Monday, July 19 at 9:25 a.m. and 12:30 p.m. pursuant to a call to duty sent to each Regent.

Interim Action by Standing Committees

            MOVED, that the Standing Committees of the Board of Regents, be and they hereby are, authorized to take interim action for the Board of Regents during the period commencing on July 21, 2010 and ending on September 12, 2010 and that any such action shall be reported to the Board at its meeting on September 13-14, 2010.

Proposed Amendment of Section 3.2 of the Rules of the Board of Regents, relating to the Regents Committees

            MOVED, that section 3.2 of the Rules of the Board of Regents be amended, as submitted, effective July 27, 2010, as an emergency action, upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to immediately conform the Rules of the Board of Regents to recent reorganization of the committee structure of the Board of Regents, so that the committees involved may efficiently assume their respective duties beginning with the next succeeding Regents meetings, and thereby assist the Board of Regents to efficiently and effectively meet its statutory responsibilities.

Acting Superintendent for the New York State School for the Blind

            MOVED, that the Regents approve the appointment of Deborah Cromwell-Stamp to serve as the Acting Superintendent of the New York State School for the Blind, beginning on July 29, 2010, until a permanent appointment has been made and the incumbent is in place.

Associate Commissioner of P-12 Special Education

            MOVED,  that the Board of Regents approve the appointment of Rebecca Cort to the position of Associate Commissioner of P-12 Education effective September 1, 2010, or such earlier date as the Board of Regents approves the appointment of a Deputy Commissioner for Adult Education and Workforce Development.  In such case, the effective date of Dr. Cort’s appointment as Associate Commissioner shall correspond to the effective date of the appointment of the Deputy Commissioner for Adult Education and Workforce Development.

Amendment of Regents Advisory Council on Library Bylaws

Emergency Amendment of Regents Rule 3.27, Relating to Museum Collection Management Policies

MOVED, that paragraph (7) of subdivision (a), and paragraphs (6) and (7) of subdivision (c), of section 3.27 of the Rules of the Board of Regents be amended, as submitted, effective August 10, 2010, as an emergency action to expire and be deemed repealed effective October 8, 2010, upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare in order to protect the public’s interest in collections held by a museum or historical society by enumerating the specific criteria under which an institution may deaccession an item or material in its collection, remove the option allowing an institution to designate a structure as a collections item but keep intact any such designation made by vote of a board of trustees prior to December 19, 2008, and specify that no proceeds from deaccessioning may be used for capital expenses, except to preserve, protect or care for an historic building previously designated as part of the institution’s collection, as above.  Emergency action is also necessary to ensure that the emergency rule remains continuously in effect until it can be adopted and made effective as a permanent rule.

Higher Education

Degree Authorization: CUNY Graduate School and University Center, for Joint Baccalaureate Degree Programs with Seven CUNY Senior Colleges

MOVED, that the Board of Regents authorize the CUNY Graduate School and University Center to award B.A., B.S., B.S. in Nursing, B.E., B.B.A., B.F.A., B.Arch., and Mus.B., degrees as part of registered joint degree programs with Baruch College; Brooklyn College; City College; Hunter College; Lehman College; Queens College; and College of Staten Island, effective July 20, 2010.

The Mandl School: Regents Authorization to Permit The Mandl School to Award the Associate in Applied Science (A.A.S) Degree

MOVED, that the Board of Regents authorize The Mandl School to award the Associate in Applied Science (A.A.S.) degree.

Conferral of Degrees: Taylor Business Institute and New York Studio School of Drawing, Painting & Sculpture

MOVED, that the Board of Regents confer upon the individuals listed, who have completed the requirements for their registered degree programs at Taylor Business Institute and the New York Studio School of Drawing, Painting & Sculpture, the respective degrees as noted.

Master Plan Amendment: Nyack College, to Authorize the College’s First Program at the Doctoral Level

MOVED, it is recommended that the Board of Regents approve the amendment to the master plan of Nyack College to authorize the College to offer its first program at the doctoral level, in support of registering a Doctor of Ministry (D.Min.) program in Christian Leadership in the Global Context. The amendment will be effective until July 31, 2011, unless the Department registers the program prior to that date, in which case master plan amendment shall be without term.

Emergency Adoption of Proposed Regulations Relating to the Establishment of Graduate Level Clinically Rich Principle Preparation Pilot Program

MOVED, that a new paragraph (6) of subdivision (a) is added to section 52.1; a new paragraph (7) is added subdivision (c) of section 52.21 and that a new subclause (3) is added to clause (a) of subparagraph (ii) of paragraph (1) of subdivision (a) of Section 80-3.10 of the Regulations of the Commissioner of Education, effective August 21, 2010 as an emergency action upon a finding by the Board of Regents that such action is necessary to protect the general welfare in order to timely implement the provisions of the proposed amendment so that the Department can begin the competitive bidding process so that institutions can begin offering these programs for the 2011-2012 school year.

Proposed Amendment to the Regulations of the Commissioner of Education Relating to Teacher Certification Flexibility to Avoid or Mitigate Reductions in Force

MOVED, that subdivisions (k), (l) and (m) be added to Section 80-4.3 of the Regulations of the Commissioner of Education, effective July 23, 2010, as an emergency action upon a finding by the Board of Regents that such action is necessary to ensure that the emergency rule remains continuously in effect until it can be adopted and made effective as a permanent rule; and

MOVED, that subdivisions (k), (l) and (m) be added to Section 80-4.3 of the Regulations of the Commissioner of Education, as submitted, effective August 11, 2010.

Amendment of Section 100.2(o) of the Regulations of the Commissioner of Education Relating to the Annual Professional Performance Review for Teachers in the Classroom Teaching Service

REGENTS COMMITTEE ON HIGHER EDUCATION

            Your Higher Education Committee held its scheduled meeting on July 19, 2010.  All members were present.

ACTION ITEMS:

Establishment of Graduate Level Clinically Rich Teacher Preparation Pilot Programs.  VOTED: That paragraph (5) of subdivision (a) of section 52.1 of the Regulations of the Commissioner of Education be added; that subparagraph (xvi) of paragraph (1) of subdivision (b) of section 52.21 of the Regulations of the Commissioner of Education be amended; that paragraph (5) of subdivision (b) of section 52.21 of the Regulations of the Commissioner of Education be added and that section 80-5.13 of the Regulations of the Commissioner of Education be amended, effective July 29, 2010, as an emergency action upon a finding by the Board of Regents that such action is necessary to ensure that the proposed amendment remains continuously in effect until its adoption as a permanent rule.

Your Committee recommends that the Board of Regents accept the invitation for New York to be a Collaborating State in the Consortium on Alternate Assessments on Alternate Achievement Standards.  [P-12 (A) 5]

Waivers from Age and Four-year Limitations for Senior Athletic Competition

Your Committee recommends that section 135.4(c)(7)(ii)(b)(1) of the Regulations of the Commissioner of Education be amended, and that section 135.4(c)(7)(ii)(d) of the Commissioner’s Regulations be added, as submitted, effective July 27, 2010, as an

emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to timely implement for the 2010-2011 school year the process for granting waivers from the age and four-year limitations for senior athletic competition to eligible students with disabilities, and thereby permit their timely participation in non-contact athletic competition for a fifth season in high school.  [P-12 (A) 6]

Academic Intervention Services (AIS)

            Your Committee recommends subdivision (ee) of section 100.2 of the Regulations of the Commissioner be amended as submitted, effective July 27, 2010, as an emergency action upon a finding by the Board of Regents that such action is necessary for the preservation of the general welfare to immediately establish modified requirements for the provision of Academic Intervention Services for the 2010-2011 school year, for purposes of minimizing the potential fiscal impact on school districts of an anticipated change in cut scores for the grades 3-8 assessments in English language arts and mathematics, and thereby ensure the timely implementation of the modified AIS requirements by school districts in the 2010-2011 school year.  [P-12 (A) 17]

Your Committee recommends that the Board of Regents approves the proposed revision to the initial charter of the Leadership Preparatory East New York Charter School as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.  [P-12 (A) 1]

Your Committee recommends that the Board of Regents approves the revision to the first renewal charter of the Excellence Charter School of Bedford Stuyvesant as proposed by the Trustees of the State University of New York, and the provisional charter is amended accordingly.   [P-12 (A) 2]

Your Committee recommends that the Board of Regents approves and issues the second renewal charter of the Harlem Link Charter School as proposed by the Trustees of the State University of New York, and that its provisional charter be extended for a term up through and including July 31, 2013.  [P-12 (A) 14]

Your Committee recommends that the Board of Regents approves the revision to the initial charter of Riverton Street Charter School as proposed by the Chancellor of the city school district of the City of New York, and the provisional charter is amended accordingly.  [P-12 (A) 15]

Your Committee recommends that the Board of Regents approves the revision to the fourth renewal charter of the Harriet Tubman Charter School, and the provisional charter is amended accordingly.  [P-12 (A) 16]

Your Committee recommends that the Board of Regents approves and issues the second renewal charter of the Opportunity Charter School as proposed by the Chancellor of the city school district of the City of New York, and that its provisional charter be extended for a term up through and including June 30, 2012.  [P-12 (A) 18]

MATTERS NOT REQUIRING BOARD ACTION

Appointment of Public Members of Boards of Education of Special Act School Districts – The Committee discussed proposed amendments to regulations that would allow for more flexibility for the appointment of public members to serve on boards of education of special act school districts.   It is sometimes difficult to find persons willing to serve at the current prescribed times (four consecutive years from July 1-June 30).  These proposed regulations would provide flexibility based upon the public members’ availability to serve.  It is anticipated that the proposed amendment will be presented to the Board of Regents for adoption at the September 2010 Regents meeting.     [P-12 (D) 1]

Timeline to Complete the P-20 Data System – The Committee was provided with an update on the work underway to carry out a major expansion of the Department’s data system, along with faster reports for data verification and a broad array of edit checks to improve data quality.  A timeline was provided showing key actions currently being taken.  The Committee discussed the possibility of including other sectors of higher education in the future (independent and proprietary colleges), as well as strategies to include data from pre-school providers.  [P-12 (D) 2]

Academic Intervention Services and the Response to Intervention Process – the Committee discussed proposed amendments to regulations that would allow a school district to provide a Response to Intervention (RTI) program in lieu of providing Academic Intervention Services (AIS) to eligible students, provided that certain conditions are met.  The proposed amendment would provide flexibility and allow school districts to:  (1) continue with a current AIS model; (2) move to or expand on an RTI model, or (3) use a blended approach of AIS and RTI.   It is anticipated that the proposed amendment will be presented for adoption at the October 2010 Regents meeting.  The Committee has asked that more information on RTI be included in the presentation in October. REGENTS COMMITTEE ON PROFESSIONAL PRACTICE

Your Professional Practice Committee held its scheduled meeting on July 19, 2010.  No public session was held this month.  All members were present.
