Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 10 licensing petitions and 29 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective September 15, 2009.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Dorothy Stawinski, an applicant for licensure as a CPA, recently passed the four parts of the Uniform CPA Examination. However, she exceeded the 18-month conditioning requirement, as required by Commissioner’s Regulations, by four and one-half months.
Ms. Stawinski sat for and passed the Auditing and Attestation (AUD) section of the Examination in May 2007. She needed to pass the remaining three sections by December 31, 2008 to retain credit for the AUD section. She passed the Regulation (REG) section in February 2008 and the Business Environment and Concepts (BEC) section in April 2008, both within the 18-month conditioning period. She passed the Financial Accounting and Reporting (FAR) section in May 2009, four and one-half months after she had lost credit for the AUD section. If her waiver request is not granted, she will lose credit for the REG section at the end of September 2009.
The Department received documentation from a New York State licensed professional describing health problems in the latter part of 2007 that affected Ms. Stawinski’s ability to pass all four sections of the Examination within the 18-month conditioning period. Ms. Stawinski’s testing history after treatment demonstrates her persistence with the Examination. She sat for the REG section twice, pulling her score up by twenty points to pass in February 2008. She sat for the BEC and FAR sections four times each, again showing her determination to pass this Examination.
Based on the licensed professional’s documentation and the strength of her personal efforts, the Executive Secretary of the State Board for Public Accountancy supports Ms. Stawinski’s petition to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Shamella Stewart, an applicant for licensure as a CPA, recently passed the four parts of the Uniform CPA Examination. However, she exceeded the 18-month conditioning requirement by six and one-half months.
Ms. Stewart has a lengthy history with the CPA Examination and has been subject to a significant number of hardware failures and administrative problems at the Examination sites. She received conditional credit for the paper-based Auditing and Attestation (AUD) and Business Environment and Concepts (BEC) sections of the Examination in May 2003 and needed to pass the two remaining sections of the Examination by May 2006 to retain credit for the AUD and BEC sections. She passed the computer-based Regulation (REG) section of the Examination in January, 2006, within the conditioning requirements, but did not pass the computer-based Financial Accounting and Reporting (FAR) section of the Examination until February 2007, nine months outside of the conditioning requirements.
During that time, Ms. Stewart experienced several administrative and technical failures that could have formed the basis for a waiver by the Regents of the conditioning requirements. She went to the wrong testing site for her REG section in May 2004 because the test vendor’s computers were not working and they were unable to confirm for which site she had been scheduled. She was prevented from rescheduling this particular section for five months due to administrative errors and confusion by the test administrator. In August 2005, she showed up to sit for the REG section again, but was unable to sit for the test due to Examination software failure. She was forced to wait until September 2005 to sit for this section.
However, Ms. Stewart did not submit a petition for waiver of the conditioning requirements at that time. Instead, she rescheduled for the AUD and BEC sections for which she had lost credit and continued to test to satisfy the regulatory requirements. Unfortunately, she continued to experience uncontrollable testing issues that interfered significantly with her ability to pass the remaining sections of the Examination. When she sat for FAR section in August 2006, the administrative systems at the testing site were problematic and she was delayed at the testing site before she was actually allowed to begin the test. In April 2007, there was construction going on at the testing site and there was significant construction noise during the time that Ms. Stewart was sitting for the AUD section. In May 2007, the administrative systems at the testing site failed once again and Ms. Stewart was delayed by 50 minutes before she was able to actually begin her test. While taking the AUD section in July 2007, the computer screen at the testing site froze causing Ms. Stewart’s AUD Examination section to appear lost for a period of time before the technical assistant was able to correct the problem. In April 2008, Ms. Stewart sat for the Business Environment and Concepts (BEC) section of the Examination but the software began “looping” and Ms. Stewart was forced to abandon her Examination and reschedule the section for May 2008. In January 2009, Ms. Stewart was once again delayed for 50 minutes before being allowed to sit for the BEC section of the Examination because of issues with the administrative software.
Despite all of these problems, Ms. Stewart did manage to pass the AUD, BEC and REG sections of the Examination again. She now has passing scores on all four of the Examination sections, albeit six and one-half months outside of the 18-month conditioning period, as follows: FAR in February 2007, AUD in April 2008, REG in July 2008 and BEC in April 2009.
Given the significant number of hardware, software and administrative failures that Ms. Stewart had to contend with and her perseverance with the Examination despite these issues, the Executive Secretary of the State Board for Public Accountancy supports Ms. Stewart’s petition to waive the 18-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing an oral examination in Massachusetts in 1993 in lieu of Part A, Fundamentals of Engineering Examination and Part B, Principles and Practice of Engineering Examination.
Statement of Problem: Mr. Malik applied for licensure in Professional Engineering in 2007. The Board has accepted twelve years of his experience and this satisfies the minimum education/experience requirement for licensure.
Mr. Malik has satisfied the examination requirement in his initial state of licensure and has been licensed in good standing with no disciplinary action in Massachusetts since 1993. Based upon his licensure and over 20 years of experience, Mr. Malik requests that the Committee on the Professions exempt him from the New York licensing examinations.
Commissioner's Regulations require that an applicant for licensure in New York State must have acceptable scores on satisfactory licensing examinations. Mr. Malik passed an oral licensing examination in Massachusetts in 1993. While the State Board for Professional Engineering agreed to waive the Part A, Fundamentals of Engineering Examination for Mr. Malik, New York State also requires the Part B, Principles and Practice of Engineering Examination. New York State does not recognize the oral examination that Massachusetts administered to Mr. Malik in 1993 as equivalent to the Examination required by New York State. Additionally, Massachusetts no longer gives oral examinations for Professional Engineering licensure. The New York State Board for Professional Engineering carefully reviewed this request to waive Part B, Principles and Practice of Engineering Examination, on two separate occasions. Both times the Board denied Mr. Malik’s request because Mr. Malik has never taken a written NCEES Professional Engineering Examination or its equivalent.

Statement of Problem: Regulations of the Commissioner require an applicant for licensure in dentistry to complete not less than 60 semester hours of pre-professional education including courses in general chemistry, organic chemistry, biology or zoology and physics. Dr. Geminiani completed a five-year dental program that included one-year of pre-professional education, including courses in chemistry and biology. After completion of the dental program, he was awarded a Master’s level degree in fixed prosthetics and prosthetic devices by the Universita Degli Studi di Siena, 2007. The State Board for Dentistry recommends that the Master’s level degree be considered as fulfillment of the pre-professional education requirement.
Additionally, Dr. Geminiani did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school. Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. He enrolled in the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester and successfully completed the program in June 2009. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

Statement of Problem: The applicants listed below have satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.
Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.
The applicant also has a pending application for full veterinary technology licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.
Applicable Guidelines: Section 6711(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinary technician in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinary technician to practice in New York State if all other licensure requirements are satisfied.

Petition for: Satisfaction of the postgraduate hospital training requirement, proficiency examination requirement and endorsement of her medical license from Italy.
Statement of Problem: Commissioner’s Regulations allow for endorsement of an applicant’s license from another jurisdiction, if appropriate requirements are met, and if the applicant has not failed any part of New York State’s licensing examination. A license granted in a country outside the United States can be endorsed if licensure in that country is regulated by an organization designated as responsible for quality assurance and acceptable to the Board of Regents. Additionally, the applicant must satisfactorily demonstrate completion of an acceptable proficiency examination, clinical competency examination, three years of ACGME-accredited postgraduate training or the equivalent, and five years of satisfactory professional experience.
Dr. Priori has not attempted any part of the New York State proficiency or licensing examinations. The Executive Secretary of the State Board for Medicine has reviewed the documentation submitted in support of Dr. Priori’s application. He recommends that her postgraduate training in Italy be accepted as the substantial equivalent of the required three years of ACGME-accredited postgraduate training.
Commissioner’s Regulations allow the Board of Regents to accept appropriate foreign medical licenses and diplomate certificates to fulfill the licensure and proficiency examination requirements as well as the clinical competency requirements for endorsement. Dr. Priori has been licensed in Italy since 1986. Her license is active and in good standing. She earned a Specialty Diploma in Cardiology from the Universita degli Studi di Milano in 1989 and a Ph.D. in Cardiovascular Physiopathology from the Universita degli Studi Roma “Tor Vergata” in 1995.
The Executive Secretary of the State Board for Medicine recommends that her Italian license be endorsed and that her Ph.D. in Cardiovascular Physiopathology be accepted to fulfill the proficiency examination requirement. He further recommends that her Specialty Diploma in Cardiology be accepted to fulfill the clinical competency requirement for endorsement.

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
