Should the Regents approve the recommendations of the Committee on the Professions pertaining to licensing petitions as listed on the attachment?
Proposed Handling
This question will come before the Professional Practice Committee at its November 2008 meeting where it will be voted on and action taken. It will then come before the full Board at its November 2008 meeting for final action.
Procedural History
Section 6506(5) of the Education Law and Section 24.7 of the Rules of the Board of Regents authorize the Regents to waive education, experience and examination requirements for a professional license as well as to confer the degree Doctor of Medicine.
Background Information
There are 2 licensing petitions and 8 requests for the conferral of the degree Doctor of Medicine for review and approval.
Recommendation
It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.
Timetable for Implementation
Approval of the Committee on the Professions’ recommendations will be effective November 18, 2008.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Commissioner's Regulations required that Ms. Bilska must pass all parts of the Uniform CPA Examination within 36 months. She recently passed all four sections of the examination; however, she exceeded the 36-month conditioning requirement by 12 months.
Ms. Bilska attended the Akademia Ekonomiczna in Poland, receiving a Licencjata in 1999 and a Magistra in 2004. She submitted copies of her transcripts to the Department in August 2003. Based on a review of these unofficial copies, she was conditionally approved to sit for the examination in October 2003. The conditions placed on this approval were that the Department receive an official transcript from the Akademia Ekonomiczna and that Ms. Bilska complete satisfactorily two required courses in which she was currently enrolled. Commissioner’s Regulations required that the conditions be met within 60 days of Ms. Bilska first sitting for the examination.
Ms. Bilska sat for and passed the Business Law and Professional Responsibility (LPR) and Accounting and Reporting (ARE) sections of the examination in November 2003. The Department received an official transcript showing that she had completed the two required courses in December 2003; however, the Department did not receive an official transcript from the Akademia Ekonomiczna within the 60-day time period. Consequently, Ms. Bilska was prohibited from sitting for other sections of examination again until the official transcript was received.
Ms. Bilska made various attempts between 2004 and 2006 to have the Akademia Ekonomiczna submit an official transcript to no avail. In October 2006, the Akademia Ekonomiczna sent an official transcript to the Department and Ms. Bilska was notified in December 2006 that she could resume testing; however, this was one month after she lost her conditional credit for the LPR and ARE sections of the examination. Ms. Bilska had relocated to Poland and she returned to New York as soon as possible. She sat for and passed the computer-based Auditing and Attestation (AUD) section of the Examination in May 2007 and the Financial Accounting and Reporting (FAR) section of the Examination in November 2007.
The Executive Secretary for the State Board for Accountancy supports Ms. Bilska’s request to waive the 36-month requirement to pass all four parts of the Uniform CPA Examination.

Petition for: Acceptance of passing grades on the Uniform Certified Public Accountancy (CPA) Examination.
Statement of Problem: Commissioner's Regulations required that Ms. Fauconier pass all parts of the Uniform CPA examination within 36 months. She passed the four parts of the Uniform CPA Examination as a candidate in the State of Washington under requirements that were different than in New York.
The national examination transitioned from a paper-based format to a computer-based format in 2004. At the point of transition, New York awarded conditional credit for sections passed under the paper-based format for a three-year period, starting with the month in which the paper-based section was passed. Ms. Fauconier passed the Business Law/Professional Responsibility and Auditing sections in May 2003. Under New York’s conditioning requirements at that time, she needed to pass the two remaining sections by the end of May 2006 to retain credit for the two sections she passed. Washington’s regulations allowed individuals who passed paper-based sections in May 2003 to retain credit for those sections until November 2006. Ms. Fauconier passed the computer-based Financial Accounting and Reporting section in January 2006 and the Regulation section in July 2006, six months outside New York’s conditioning requirement.
The Executive Secretary for the State Board for Accountancy supports Ms. Fauconier’s request to waive the 36-month requirement to pass all four parts of the Uniform CPA Examination.

MEDICINE
Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.
Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.
The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department. Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
