Issue for Discussion:

 

Should the Regents amend section 29.2 of the Rules of the Board of Regents to extend to all practice settings the requirement that licensed health professionals wear name badges that identify which profession that they are licensed to practice?

Proposed Handling

 

The proposed amendment is before the Committee for discussion in January 2008.  The amendment will be submitted for action at the March 2008 Regents meeting.

 

Procedural History

 

A Notice of Proposed Rule Making concerning the proposed amendment will be published in the State Register on December 26, 2007.

 

Background Information

 

Currently, it is considered unprofessional conduct for those practicing in certain health professions, other than physicians, physician assistants, and specialist assistants, to fail to wear an identifying badge while practicing as an employee or operator of a hospital, clinic, group practice or multiprofessional facility, registered pharmacy, or at a commercial establishment offering health services to the public.  The proposed amendment will provide additional public protection by expanding to all practice settings, including private offices, the requirement that health professionals wear identifying badges.  The proposed amendment is needed to help patients know from whom they are receiving professional services.

AMENDMENT TO the RULES OF the BOARD OF REGENTS

              Pursuant to sections 207, 6504, 6506, and 6509 of the Education Law.

Paragraph (9) of subdivision (a) of Section 29.2 of the Rules of the Board of Regents is amended, effective April 10, 2008, as follows:

(9)  failing to wear an identifying badge, which shall be conspicuously displayed and legible, indicating the practitioner's name and professional title authorized pursuant to the Education Law, while practicing such profession [as an employee or operator of a hospital, clinic, group practice or multiprofessional facility, registered pharmacy, or at a commercial establishment offering health services to the public];
