SUMMARY

Issue for Decision (Consent Agenda)

Should the Regents accept the staff recommendation to register the public elementary and middle schools listed in the attached table?

Reason(s) for Consideration

Required by Commissioner’s Regulations Section 100.2(p).

Proposed Handling

The question will come before the Regents EMSC Committee for action in November 2008.

Procedural History

Beginning in July 2003, the Regents have annually approved the registration of new public schools.

Background Information

Commissioner’s Regulations require districts that seek to register a public elementary, intermediate, middle, junior high or high school to submit a petition to the Board of Regents. Commissioner’s Regulations require petitions for schools opening the following school year to be submitted by June 15; however, the Commissioner may waive this timeline for good cause.  This year the Department received submissions after June 15 from the Bethlehem Central School District to register the Eagle Elementary School and from the Newburgh Enlarged City School District to register the West Street Elementary School. Based upon the district submitting a petition and supporting materials certifying the district’s commitment to operate a school in compliance with applicable statutes, rules, and regulations relating to public schools and in compliance with applicable building codes, the Commissioner recommends that the schools listed on Attachment A be registered effective with the beginning of the 2008-2009 school year.

Attachment A provides a listing of those schools for which districts have petitioned for registration effective with the beginning of the 2008-2009 school year.

Recommendation

VOTED: That the schools on the attached table be registered.

Timetable for Implementation
