SUMMARY:

Attached is a proposed amendment of the Regulations of the Commissioner of Education to add a new section 107.2, relating to driver education courses. Supporting materials for the proposed amendment are available upon request from the Secretary to the Board of Regents. The proposed amendment will be submitted for approval in November.

The purpose of the proposed amendment is to comply with Chapter 644 of the Laws of 2002, which requires the Commissioner to establish a certification process for driver education courses of the amount of time a holder of a class DJ or class MJ learner's permit has spent operating a motor vehicle while under the immediate supervision of a driver education teacher. The proposed amendment provides that the driver education teacher in a driver and traffic safety education course approved by the Commissioner shall, upon the request of his or her student, certify on a form prescribed by the Commissioner of Motor Vehicles the number of hours such student spent operating a motor vehicle under the supervision of the driver education teacher.

A Notice of Proposed Rule Making will be published in the State Register on September 24, 2003.

AMENDMENT TO THE REGULATIONS OF THE COMMISSIONER OF EDUCATION

Pursuant to sections 207, 305 and 806-a of the Education Law and Chapter 644 of the Laws of 2002.

Part 107 of the Regulations of the Commissioner of Education is amended, effective December 4, 2003, by adding section 107.2 as follows:

107.2 Certification of supervised hours in driver education courses pursuant to Education Law section 806-a(2).

The driver education teacher in a driver and traffic safety education course approved by the Commissioner shall, upon the request of his or her student who is the holder of a class DJ or class MJ learner's permit, certify on a form prescribed by the Commissioner of Motor Vehicles the number of hours such student has spent operating a motor vehicle while under the immediate supervision of such driver education teacher.
