Background Information

 

Education Law §6506(3) authorizes the Board of Regents to charter schools offering educational programs for the professions regulated under Education Law Title 8. Education Law §216 provides that no institution or association which might be incorporated by the Regents shall, without their consent, be incorporated under any other general law.  The proposed business corporation seeks to establish a school of massage therapy to offer a licensure-qualifying program in massage therapy and continuing education courses to licensed massage therapists. Staff in the Office of the Professions has determined that the proposed program leading to a non-credit diploma meets the Regulations of the Commissioner of Education for registration.

 

Recommendation

           

It is recommended that the Regents approve the application in accordance with the recommendation contained in the attached summary.

APPLICATION FOR REGENTS APPROVAL TO FILE A CERTIFICATE OF INCORPORATION UNDER THE BUSINESS CORPORATION  LAW

BROOKLYN INSTITUTE OF MASSAGE THERAPY, INC.

The board of directors has applied for the approval of the Board of Regents pursuant to Education Law §§216 and 6506(3) and the consent of the Commissioner of Education, to the filing of a certificate of incorporation under Business Corporation Law §402(a) to offer a licensure-qualifying program in massage therapy. The certificate of incorporation provides that the corporation shall be subject to and comply with all of the provisions of the Education Law, Rules of the Board of Regents and Regulations of the Commissioner of Education that would be applicable to a corporation created pursuant to Education Law §216. The Office of the Professions recommends that the approval of the Board of Regents and the consent of the Commissioner of Education to the filing of such certificate of incorporation be granted.
