Procedural History

 

Section 6506(5) of the Education Law and Part 24.7 of the Rules of the Board of Regents authorizes the Regents to waive education, experience and examination requirements for a professional license as well as confer the degree Doctor of Medicine.

 

Background Information

 

There are 23 licensing petitions and 10 requests for the conferral of the degree Doctor of Medicine for review and approval.

 

Recommendation

 

It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.

 

Timetable for Implementation

 

Approval of the Committee on the Professions’ recommendations will be effective October 24, 2006.

ARCHITECTURE

 

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

 

Summary Statement:  The petitioners listed below are all graduates of professionally accredited architecture programs who have applied for licensure in New York.  All have achieved, at a minimum, a Bachelor of Architecture degree.  All petitioners have substantial documented licensed experience in other states.

 

            Prior to 1983, certain states did not require the Equivalency Examination (EE) or the Qualifying Test (QT) if a candidate had a degree from an accredited architecture program, and granted licensure upon passage of the Professional Examination (PE).  Prior to 1975, most states recognized the Examination Syllabus (ES).  The petitioners passed either the national Professional Examination (PE) given prior to 1983, or portions of the national Examination Syllabus (ES) given prior to 1975.  Prior to 1983, New York State required passage of the Equivalency Examination (EE), or passage of the Qualifying Test (QT) in addition to passage of the national Professional Examination.  Each of the petitioners satisfied the examination requirement in his/her initial state of licensure by passing an acceptable licensing examination and attained licensure in that state.

 

            Section 7304(4) of Education Law and Section 69.3 of the Commissioner’s Regulations require for endorsement that “… an architect licensed in another state or jurisdiction as the result of successful completion of only the professional examination in use before 1983 may be granted licensure upon presentation of evidence of two years of work experience of a grade and character satisfactory to the State Board for Architecture and passage of a practical examination satisfactory to the State Board for Architecture …”

 

            Each petitioner satisfied the examination requirement in his/her initial state of licensure and has extensive professional practice satisfactory to the State Board.  Since the above information illustrates evidence of competence within the profession, and in lieu of the practical examination, the Executive Secretary of the State Board for Architecture recommends that the examination requirement be considered satisfied and each applicant’s licensure in another state be accepted for endorsement in New York State.

Petition for:  Waiver of licensing examination requirement.

 

Statement of Problem:  Dr. Clemmens was originally licensed in 1975 as a registered professional nurse (RN) in Ontario, Canada after completing a Bachelor of Science degree in Nursing from Laurentian University. The College of Nurses of Ontario reports that she passed the Canadian Nurses Association Testing Service Nurse Registration Examination. Even though she passed this examination, New York State requires that an applicant for licensure pass the NCLEX examination. Dr. Clemmens was also licensed in Connecticut in 1992 as an RN by endorsement of her Canadian license. That state did not require her to take the NCLEX examination.

 

Dr. Clemmens received a Master of Science degree in Nursing in 1984 from the University of Toronto, a Ph.D. degree in Nursing in 2000 from the University of Connecticut, and completed a postdoctoral research fellowship in Psychosocial Oncology from the Yale University School of Nursing in 2002 while on a U.S. Department of Defense grant.  Her career includes significant practice in a variety of positions, including: medical-surgical nursing; neonatal care; public health nursing; school nursing; clinical specialist in perinatology; administrative director of nursing in obstetrics and gynecology in a regional tertiary care facility with over 3,500 births annually; program director of the perinatal program at a university teaching hospital with over 350 FTEs, a $20 million budget and over 5,000 births annually; consultant to the World Health Collaborating Center for International Development in Nursing Leadership, Administration and Clinical Issues for Program Development in Poland, China and the Bahamas; and faculty member at the University of Connecticut and New York University. 

 

Dr. Clemmens is a recognized authority on nursing care related to maternal child health, has written and presented extensively on this specialty area and has received significant grants from both Canada and the United States funding research on related topics. Based on her unique combination of education and experience, the Executive Secretary of the State Board for Nursing recommends that the NCLEX licensing examination requirement be waived.


 

APPLICABLE REQUIREMENTS:

 

QUALIFICATIONS:

Section 6905 of the Education Law and Section 64.1 of the Regulations of the Commissioner of Education require:

 

(1)  Graduation from a general nursing program of at least two academic years in a country outside the United States that is satisfactory to the Department and recognized by the licensing authorities of that country as being preparation for practice as a registered professional nurse.

(1)  Laurentian University, Sudbury, Ontario, Canada, B.S. in Nursing, 1975; University of Toronto, Toronto, Canada, M.S. in Nursing, 1984; and university of Connecticut, Storrs, Connecticut, Ph.D., 2000.

 

(2) Satisfactory scores on the National Council Licensure Examination.

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Nursing, recommends that the applicant’s petition for waiver of the NCLEX licensing examination be approved.

 


DIETETICS-NUTRITION

Petition for:  Satisfaction of the education requirement for the associate degree route.

             

Statement of Problem:  Ms. Rembert was awarded a B.A. degree in Home Economics from Queens College in 1979 and subsequently completed an additional course in nutrition at Queens College and 20 semester hours of biological science courses at Medgar Evers College. Commissioner's Regulations require a minimum of 45 semester hours of study in the professional content area of dietetics and nutrition for applicants seeking licensure through the baccalaureate degree route. The coursework Ms. Rembert completed in her combined studies covers all the required subject areas in both the professional content area and the content area of human biological sciences and social and behavioral sciences; however, she has only approximately 30 semester hours in the professional content area. 

 

            The semester hours of study completed by the applicant satisfy all the educational requirements for the associate degree route, which requires a passing score on the licensing examination. Ms. Boyce, however, was not awarded an associate degree. The applicant asks that the Board of Regents accept her Bachelor of Arts degree completed at Queens College along with her other college study as the substantial equivalent of an associate degree in dietetics and nutrition.         

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS: 


Section 8004 of the Education Law and Part 79.6 of the Commissioner's Regulations which require for the associate route:

 

(1)  An associate degree based on a program in dietetics or nutrition which includes the equivalent of at least 30 semester hours in the nine curricular areas that constitute the professional dietetics and nutrition content area and at least 15 semester hours in the human biological sciences and social and behavioral sciences content area, and

(1)  See Statement of Problem.

 

a) Queens College, Flushing, New York, B.A. in Home Economics, June 1979, and 3 semester credits, fall 1996.

b) Medgar Evers College, Brooklyn, New York, 20 semester hours in biological sciences, 2001 – 2004.


 

(2)  Completion, in the 15 years preceding application, of 10 full-time equivalent years of experience and education in the field of dietetics, including a minimum of 2.5 equivalent years of planned work experience, acceptable to the New York State Board for Dietetics and Nutrition.

 

(2)  Over 10 years of acceptable full-time equivalent experience, including planned work experience.

(3)  Endorsements from three dietitians or nutritionists acceptable to the Department.

(3)  Endorsements from three dietitians acceptable to the Department.

 

(4)  Satisfactory scores on an acceptable examination.

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Dietetics and Nutrition, recommends that the applicant's education be considered satisfied for licensure through the associate degree route.

Statement of Problem:  The Regulations of the Commissioner of Education require evidence of the completion of two academic years of study in general dentistry at an accredited dental school program which culminated in certification that the applicant achieved the level of knowledge and clinical proficiency expected of a graduate of a registered or accredited dental school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school.  Dr. Leder completed the two-year General Dentistry program at the University of Rochester Eastman Dental Center.  This program is acknowledged by the State Board for Dentistry as the equivalent of the two-year program required in regulation.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 61 of the Regulations of the Commissioner of Education requires:

 

(1) Not less than 60 semester hours of preprofessional education including courses in general chemistry, organic chemistry, biology or zoology, and physics.

Statement of Problem: The Regulations of the Commissioner of Education require           evidence of the completion of two academic years of study in general dentistry at an accredited dental school program which culminated in certification that the applicant achieved the level of knowledge and clinical proficiency expected of a graduate of a registered or accredited dental school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school.  Dr. Iida completed the two-year General Dentistry program at the University of Rochester – Eastman Department of Dentistry.  The Dean of the School of Dental Medicine has confirmed that this program is a two-year general dentistry program as required in regulation.  The Executive Secretary of the State Board for Dentistry supports the applicant’s request.

            Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

 

Applicable Guidelines: Section 6604(6) of the Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for:  Acceptance of education as being the substantial equivalent of a registered program.

 

Statement of Problem:  Ms. Varney did not complete a physical therapist assistant or physical therapy program as required.  She successfully completed all didactic courses in the physical therapy program at SUNY Upstate Medical University except for one of the four clinical courses.  While enrolled in that program, the applicant completed 532 clinical hours. She is requesting that her studies be considered equivalent to an approved program for physical therapist assistants.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 6740 of the Education Law and Part 77 of the Regulations of the Commissioner of Education requires for physical therapist assistants:

 

(1)  Completion of a two-year New York State registered or American Physical Therapy Association (APTA) accredited college program for physical therapist assistants OR

            Completion of a physical therapy program determined by the Department to be the equivalent to a registered physical therapist assistant program.

(1) SUNY Geneseo, Geneseo, New York, 26 semester hours, 1999 – 2000; Finger Lakes Community College, Canandaigua, New York, A.S., May 2002; SUNY Upstate Medical University, Syracuse, New York, B.S. in Health Sciences, April 2006 (prior to degree conferral was enrolled in the University’s approved physical therapy program and completed all didactic courses and 532 clinical hours).

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Physical Therapy, recommends that the applicant's education be accepted as the equivalent of a registered physical therapist assistant program upon documentation of passing scores on the national physical therapy or physical therapist assistant examination.


 

THREE-YEAR LIMITED LICENSE IN VETERINARY MEDICINE

 

Petition for:  Three-year limited license to practice veterinary medicine under Section 6704(6) of the Education Law.

 

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

            Each applicant also has a pending application for full veterinary medical licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

Applicable Guidelines: Section 6711(6) of the Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a veterinary technician in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien veterinary technician to practice in New York State if all other licensure requirements are satisfied.

Petition for:  Acceptance of education.

 

Statement of Problem: Commissioner's Regulations require that an applicant for medical licensure complete an acceptable medical education program and receive a medical degree. Dr. Eskarous completed all academic requirements for the medical degree, including coursework, internship, social service and final examinations. Due to immigration requirements and the Mexico Department of Education’s problem in certifying and revalidating his Egyptian high school studies, Dr. Eskarous’ medical degree was never awarded.   

           

Dr. Eskarous requests that his completion of all academic requirements for the awarding of the medical degree at the Universidad Mexico Americana del Norte be accepted to satisfy New York State’s education requirements for licensure.  Based on his unique circumstances, the Executive Secretary of the State Board for Medicine supports his request.  

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Sections 60.1 and 60.5 of the Commissioner’s Regulations require:

 

(1) Six years of postsecondary education, including a medical education at least 32 months in length.

(1)      Universidad Mexico Americana del Norte, Reynosa, Mexico, 1988 - 1993.

(2) Proficiency examination.

(2) ECFMG Certification, November 1999.

(3) Three years of approved postgraduate hospital training.

(3) PGY 1, 2, and 3 in pediatrics from July 1, 2001 to June 30, 2004 at Lincoln Medical and Mental Health Center, New York, New York.

(4) Acceptable scores on the New York State licensing examination.

(4) Acceptable scores on USMLE Step 1 (October 1997), USMLE Step 2 (August 1998), and USMLE Step 3 (March 2006).


 

(5) United States citizen or alien lawfully admitted for permanent resident status in the United States.

(5) United States citizen.

(6) Evidence of good moral character.

(6) Good moral character.

(7) Evidence of the required course in the identification and reporting of child abuse and maltreatment.

(7) Certificate of Completion.

 

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Medicine, recommends that the applicant’s preprofessional and professional education be considered satisfied.

 

 

 

 

 

 

 

 

 


 

MEDICINE

 

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

 

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

 

            The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department.  Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
