certification of school and district level educational leaders consistent with
the more rigorous preparation standards for school leadership programs at
institutions of higher education adopted by the Regents in July
2003?

Preliminary draft regulatory
language will be submitted to the HE/PP Committee for initial discussion on May
16, 2005. Follow up discussion by
the HE/PP Committee on the preliminary draft proposal and public commentary on
that proposal will continue in June and possibly September. It is anticipated
that the HE/PP Committee will conclude its discussion and move recommended draft
amendments to Part 80 of the Commissioner’s regulations to the full Board of
Regents for action in the fall of 2005.
Procedural
History
In October 2001, a Blue Ribbon
Panel on School Leadership, commissioned by the Board of Regents and
Commissioner of Education, issued a report containing a series of findings and
recommendations to improve the preparation of educational leaders certified to
work in the State’s public schools. In December 2002, Department staff used the
findings and recommendations from this report to develop draft language for a
new regulation establishing more rigorous standards for the registration of
programs at institutions of higher education leading to certification as a
school building or school district level educational leader. After conducting a series of public
hearings on this proposal through the winter and spring of 2003, the Board of
Regents adopted new standards in Part 52 of the Commissioner’s Regulations for
the registration of programs at institutions of higher education for the
preparation of school building and school district level educational leaders in
July 2003. These new standards
became effective for all institutions of higher education with educational
leadership programs in September 2004.
In January 2005, the HE/PP Committee discussed the work accomplished to
date and ongoing work necessary to continue implementation of the Regents’
educational leadership initiative.
At the request of the HE/PP Committee, Department staff has developed
preliminary draft language to amend Part 80 of the Commissioner’s Regulations to
establish certification requirements for school building and district level
educational leaders consistent with the Part 52 standards previously approved by
the Regents for the preparation of educational leaders by institutions of higher
education. These preliminary draft
amendments are presented now for the HE/PP Committee’s initial
consideration.
The preliminary draft proposal would amend Part 80 of the Commissioner’s regulations to establish new names for the certificate titles in the educational leadership service consistent with the changes for the institutions of higher education with registered programs for the preparation of educational leaders in September 2004. Under this proposal, the current “School Administrator and Supervisor” certificate would become the new “School Building Leader certificate”; the current “School District Administrator” certificate would become the new “School District Leader” certificate and the current “School Business Administrator” certificate would become the new “School District Business Leader” certificate.
The proposal would further amend Part 80 to establish new education, examination and experience requirements for candidates to qualify for certification as a School Building Leader, School District Leader and School District Business Leader (Attachments A, B and C compare the specific elements of the proposed new certification requirements with the current certification requirements). Significantly, the proposed amendments to Part 80 would require all applicants for the new educational leadership certificates to:
· Complete a registered educational leadership program at an institution of higher education determined by the Department to comply with the new, more rigorous preparation standards required by the Regents’ in Part 52 of the Commissioner’s Regulations. Such programs require a candidate to participate in an internship experience working in schools with students at various developmental levels and socioeconomic backgrounds culminating in a 15 week full-time leadership experience supervised by experienced school district leaders and program faculty.
· Pass the NYS certification examination appropriate to the certificate sought. The Office of Teaching Initiatives is currently working with National Evaluation Systems and committees of experienced educational leaders from around the State to develop these new certification exams. The Department anticipates that the first administration of these new certification exams will occur in the summer of 2006.
· All new Professional certificate holders will be required to perform specified professional development in order to retain certification.
Recommendation
Department staff recommend that
the Regents adopt the proposed amendments to Part 80 of the Commissioner’s
Regulations in order to conform the certificate titles and certificate
requirements for educational leaders to the competency standards articulated in
Part 52 of the Commissioner’s Regulations for programs approved by the
Department for the training of educational leaders at institutions of higher
education.
Timetable for
Implementation
At the request of the Board of
Regents, Department staff has developed this preliminary draft regulation for
consideration by the HE/PP Committee as the next essential step in the Regents’
ongoing efforts to improve the quality of educational leadership in the State’s
schools. The Professional Standards
and Practices Board for Teaching discussed and approved the proposed elements in
the preliminary draft now before you at its regular meeting in March. We anticipate that the HE/PP Committee
will engage in ongoing discussions regarding this preliminary draft regulation
during the May, June and September meetings of the Board of Regents. Throughout this period, Department staff
will solicit comments on the preliminary draft regulation from the public and
will share these comments with the HE/PP Committee to facilitate the further
refinement of the proposal. We
anticipate submission of the proposal to the full Board of Regents for action in
the fall of 2005. The proposal
contemplates that the new educational leadership certificate titles and
certification requirements will become effective in September
2006.

11. Paragraph (1) of subdivision (a) of
section 80-3.3 of the Regulations of the Commissioner of Education is amended,

(1) Duration. The initial certificate in the classroom teaching
service shall be valid for five years from its effective date.
12. Paragraph (2) of subdivision (a) of
section 80-3.3 of the Regulations of the Commissioner of Education is amended,

(2) A candidate with a baccalaureate or
higher degree who holds a certificate issued by the National Board for
Professional Teaching Standards in a title which the department has determined
to be equivalent to the title of the initial certificate in the classroom
teaching service sought shall be deemed to have met the requirements for
such initial certificate prescribed in subdivision (b) or (c) of this
section.

The title of section 80-3.4 of the Regulations of the Commissioner of
Education is amended, effective _____, 2005, as

80-3.4 Requirements for the professional
certificate in the classroom teaching service.
14. Subdivision (a) of section 80-3.4 of the
Regulations of the Commissioner of Education is amended, effective ____, 2005,
as follows:
(a) General requirements.
(1) Validity of certificate. The professional
certificate in the classroom teaching service shall be continuously
valid, provided that the professional development requirement prescribed in
section 80-3.6 of this Subpart is met by the professional certificate holder.
The professional certificate holder shall be required to meet such professional
development requirement to maintain the continued validity of the professional
certificate.
(2)
The candidate shall meet the requirements for the initial certificate
in the classroom teaching service for the certificate title sought or the
requirements for the transitional certificate for career changers and others
holding a graduate degree or professional degree, as prescribed in section
80-3.5(a) of this Subpart, for the certificate title
sought.
15. Paragraph (2) of subdivision (a) of
section 80-3.6 of the Regulations of the Commissioner is amended, effective
_____, 2005, as follows:
(2) Professional development period means the
five-year period commencing on July 1st after the effective date of the
[triggering] certificate, and each subsequent five-year period thereafter for
the certificate for which the professional development is
required.
16. Paragraph (5) of subdivision (a) of
section 80-3.6 of the Regulations of the Commissioner of Education is repealed,
effective ______, 2005.
17. Subdivision (b) of section 80-3.6 of the
Regulations of the Commissioner of Education is amended, effective ____, 2005,
as follows:
(b) Mandatory requirement.
(1)
Requirements.
(i) Requirement for holders of professional
certificates in the classroom teaching service. The holder of a professional
certificate in the classroom teaching service shall be required to successfully
complete 175 clock hours of acceptable professional development during the
professional development period.
(ii) Requirement for holders of level III
teaching assistant certificates. The holder of a level III teaching assistant
certificate shall be required to successfully complete 75 clock hours of
acceptable professional development during the professional development
period.
(iii) Requirements for holders of professional certificates in the educational leadership service.
(a) The holder of a school building leader certificate in the educational leadership service shall be required to successfully complete 175 clock hours of acceptable professional development during the professional development period.
(b) The holder of a school district leader certificate in the educational leadership service shall be required to complete 175 clock hours of acceptable professional development during the professional development period.
(c) The holder of a school district business leader certificate in the educational leadership service shall be required to complete 175 clock hours of acceptable professional development during the professional development period.
(2) The professional development requirement
prescribed in paragraph (1) of this subdivision shall be reduced by 10 percent
for each professional development year the certificate holder is not regularly
employed by an applicable school in New
York.
(3) The professional development requirement
prescribed in this subdivision may be completed at any time during the five-year
professional development period.
(4) Notwithstanding the requirements of
paragraph (1) of this subdivision, a holder of a certificate in the classroom
teaching service who achieves certification from the National Board for
Professional Teaching Standards shall be deemed to have met the professional
development requirement, prescribed in this subdivision, for the five-year
professional development period in which such national board certification is
achieved.
(5) An individual holding more than one professional certificate in the classroom teaching service and/or educational leadership service shall only be required to complete 175 clock hours of professional development during any five year professional development period. A portion of such professional development must be completed in each of the content areas or related pedagogy of the certificates held.
18. Subdivision (d) of section 80-3.6 of the
Regulations of the Commissioner of Education is repealed and a new subdivision
(d) of section 3.6 is added, effective ___, 2005, as
follows:
(d) Acceptable professional development. Acceptable professional development shall be such professional development activities as approved by the applicable school district in New York, pursuant to its professional development plan, as prescribed in section 100.2 (dd) of this Title.
19. Subdivision (g) of section 80-3.6 of the
Regulations of the Commissioner of Education is amended, effective ___, 2005, as
follows:
(g) Reporting requirement.

[(2)] Each certificate holder required to
complete the professional development requirement pursuant to this section shall
report to the executive director of the office of teaching initiatives his or
her current mailing address. Each such certificate holder shall report to the
executive director a change of his or her mailing address within 30 days of such
change. Failure to provide the executive director with a valid current mailing
address may result in the suspension of the validity of the teaching certificate
or certificates for which professional development is required, as prescribed in
subparagraph (h)(2)(ii) of this section.
20. Subdivision (i) of section 80-3.6 of the
Regulations of the Commissioner of Education is repealed and a new subdivision
(i) of section 80-3.6 is added, effective ____, 2005, as
follows:
(i) Restoration of validity of certificate(s). To restore the validity of a certificate(s) whose validity has been suspended for failure to satisfy the professional development requirement set forth in this section, the candidate shall be required to demonstrate that he or she has met the deficiency which caused the suspension in validity applicable to the five-year professional development period in which the deficiency occurred consistent with the direction of the Commissioner of Education.
21.
The title of section 80-3.7 of the Regulations of the Commissioner of
Education is amended, effective ____, 2005, as
follows:
80-3.7 Satisfaction of education requirements
for certification in the classroom teaching service through individual
evaluation.
22. Section 80-3.10 is added to the
Regulations of the Commissioner of Education, effective _____, 2005, as
follows:
80-3.10 Certificates for educational leadership service
(a) School building leader (principal,
housemaster, supervisor, department chairman, assistant principal, coordinator,
unit head and any other person serving more than 25% of his or her assignment in
any building level leadership position shall hold this certificate).
(1) Initial
certificate.
(i) Validity of certificate. The Initial certificate shall be valid
for five years from its effective date.
(ii) Requirements for an Initial certificate as a school building leader in the educational leadership service. The candidate shall meet the requirements in each of the following clauses:
(a) Education. The candidate shall meet the education requirement by meeting the requirements in one of the following subclauses:
(1) The candidate shall have satisfactorily completed a program leading to certification as a school building leader in the educational leadership service pursuant to section 52.21(c)(2) of this Title. As part of the program completion requirements, the candidate shall have been awarded a master’s degree.
(2) Interstate agreement on qualifications of educational personnel. The candidate may meet the educational requirement by successfully completing a program of preparation for a school building leader or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel.
(b) Examination. The candidate shall submit evidence of having achieved a satisfactory level of performance on the New York State assessment of school building leadership.
(2) Professional
certificate:
(i) Validity of certificate. The Professional school building leader certificate shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this Subpart is met by the professional certificate holder.
(ii) Requirements for a Professional certificate as a school building leader in the educational leadership service. The candidate shall have completed, in addition to the requirements for the Initial certificate: three years of teaching and/or administrative and /or supervisory and/or pupil personnel service experience in public or non-public schools N - 12. The candidate who completes this requirement in total or part through providing educational leadership service in New York public schools shall be required to participate in a mentored program in the first year of employment, as prescribed in Part 100 of this Title, unless the candidate has successfully completed two years of educational leadership service prior to such public school service.
(b) School district leader (superintendent of schools, district superintendent, deputy superintendent, associate superintendent, assistant superintendent and any other person having responsibilities involving general district-wide administration, except school district business leader, shall hold this certificate - holders of a school district leader certificate may not serve as a school building leader unless such individual meets the requirements in subdivision (a) of this section for certification as a school building leader).
(1) Validity of certificate. The Professional school district leader certificate shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this subpart is met by the Professional certificate holder.
(2) Requirements for a Professional school district leader certificate in the educational leadership service. The candidate shall meet the requirements of subparagraphs (i) or (ii) of this paragraph.
(i) Regular route. The candidate shall meet the requirements in each of the following clauses:
(a) Education. The candidate shall meet the education requirement by meeting the requirements in one of the following subclauses:
(1) The candidate shall have satisfactorily completed a program leading to a certificate as a school district leader in the educational leadership service registered pursuant to section 52.21(c)(3) of this Title. As part of the program completion requirements, the candidate shall have earned at least sixty semester hours of graduate study, achieved a satisfactory level of performance on the New York State assessment of school district leadership and have been awarded a master’s degree.
(2) Interstate
agreement on qualifications of educational personnel. The candidate may meet the educational
requirement by successfully completing a program of preparation for a school
district leader certificate or its equivalent at an institution of higher
education approved pursuant to section 3030 of the Education Law, the interstate
agreement on the qualifications of educational personnel and achieving a
satisfactory level of performance on the New York State assessment of school
district leadership.
(b) Experience. The candidate shall have successfully completed three years of teaching and/or administrative and/or supervisory and/or pupil personnel service experience in public or non-public schools N - 12.
(ii) Exception to stated preparation. The Commissioner of Education, at the request of a board of education or board of cooperative educational services, may provide for the issuance of a Professional certificate as school district leader to exceptionally qualified persons who seek appointment to serve as a superintendent of schools, who do not meet all of the graduate course or school teaching requirements in subparagraphs (i) of this paragraph, but whose exceptional training and experience are the substantial equivalent of such requirements and qualify such persons for the duties of a superintendent of schools. Prior to the appointment of any such individual, the board must obtain the approval of the commissioner. In its formal request to the department the board must submit its resolution noting approval of the request, the job description, its rationale for requesting such certification of the individual, a statement identifying the exceptional qualifications of the candidate, the individual’s completed application for certification, vitae and official transcripts of collegiate study. The certificate, if issued, will be valid only for service in the district making the request. The commissioner will refer the materials submitted by the board to a screening panel consisting of representatives of the department and appropriate educational organizations for review and advice.
(c) School
district business leader (deputy superintendent of schools for business,
associate superintendent of schools for business, assistant superintendent of
schools for business and any other person having professional responsibility for
the business operation of the school district shall hold this
certificate)
(1) Validity
of certificate. The Professional
school district business leader certificate shall be continuously valid,
provided that the professional development requirement prescribed in section
80-3.6 of this Subpart is met by the Professional certificate
holder.
(2)
Requirements for a Professional school district business leader in the
educational leadership service. The
candidate shall meet the requirements of either subparagraphs (i) or (ii) of
this paragraph.
(i) The
candidate shall have satisfactorily completed a program leading to a certificate
as a school district business leader in the educational leadership service
registered pursuant to section 52.21(c)(5) of this Title. As part of the program completion
requirements, the candidate shall have earned at least sixty semester hours of
graduate study, achieved a satisfactory level of performance on the New York
State assessment of school district business leadership and have been awarded a
master’s degree.
(ii)
Interstate agreement on qualifications of educational personnel. The candidate may meet the educational
requirement by successfully completing a program of preparation for a school
district business leader certificate or its equivalent at an institution of
higher education approved pursuant to section 3030 of the Education Law, the
interstate agreement on the qualifications of educational personnel and
achieving a satisfactory level of performance on the New York State assessment
of school district business leadership.
23. The title of Subpart 80-5 of the
Regulations of the Commissioner of Education is amended, effective _____, 2005,
as follows:
REQUIREMENTS RELATING TO CLASSROOM
TEACHING AND EDUCATIONAL LEADERSHIP PRACTICE AND SPECIALIZED
CREDENTIALS.
24. Section 80-5.15 is repealed and a new
section 80-3.15 is added to the Regulations of the Commissioner of Education,
effective ____, 2005, as follows:
80-3.15 Transitional D certificate for
service as a school district leader (superintendent of schools, district
superintendent, deputy superintendent, associate superintendent, assistant
superintendent, and any other person having responsibility for general
district-wide administration, except those responsibilities defined for school
district business leaders)
(a) Validity of certificate. The Transitional D certificate shall be
valid for three years from its effective
date.
(b) Requirements for a Transitional D
certificate as a school district leader in the educational leadership
service.
(1) Education. The candidate shall hold a graduate
academic or graduate professional degree from a regionally accredited
institution of higher education or from an institution authorized by the Board
of Regents to confer degrees. A
candidate shall complete study in the means for identifying and reporting
suspected child abuse and maltreatment in accordance with section 3004 of the
Education Law as well as at least two clock hours of coursework or training in
school violence prevention and intervention, as required by section 3004 of the
Education Law, provided by a provider approved or deemed approved by the
department pursuant to Subpart 57-2 of this Title.
(2) Examination. The candidate shall submit evidence of
having achieved a satisfactory level of performance on the New York State
assessment of school district leadership.
(3) Admission into an alternative
program. The candidate shall submit
evidence of being admitted to an alternative school district leader
certification program pursuant to section 52.21(c)(4) (ii) of this Title and
endorsement by such program for a Transitional D
certificate.
(4)
Employment and support commitment. The candidate shall submit
satisfactory evidence of having a commitment from a school district of three
years employment as a school district leader, which includes mentoring and
support as prescribed in section 52.21(c)(4)(iii)(a)(1).
