          The question will come before the HE & PP Committee on May 16, 2005, on its consent agenda, where it will be voted on and final action taken.

 

Procedural History

 

          Section 6506(5) of the Education Law and Part 24.7 of the Rules of the Board of Regents authorizes the Regents to waive education, experience and examination requirements for a professional license as well as confer the degree Doctor of Medicine.

 

Background Information

 

          There are 19 licensing petitions and 25 requests for conferral of the degree Doctor of Medicine for review and approval.


Recommendation

 

It is recommended that the Regents approve the recommendations of the Committee on the Professions regarding licensing petitions.

 

Timetable for Implementation

THREE-YEAR LIMITED LICENSE IN PHARMACY

 

Petition for: Three-year limited license to practice pharmacy under Section 6805(6) of the Education Law.

 

Statement of Problem:

 

The applicants listed below have met the education, examination and experience requirements for licensure as a pharmacist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant also has a pending application for full pharmacy licensure, which cannot be granted until he/she satisfies the citizenship or permanent residency requirement.

 

Applicable Guidelines:

 

Section 6805(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a pharmacist in New York State and allows the Board of Regents to grant a one-time. three-year waiver (plus an extension of not more than one year) for an alien pharmacist to practice in New York State if all other licensure requirements are satisfied.

ACUPUNCTURE

Petition for:  Satisfaction of pre-professional education requirement. 

 

Statement of Problem:  Mr. Wu was admitted to the American International Acupuncture Institute on the basis of his study from 1990 to 1994 at Huatuo College of Traditional Chinese Medicine (TCM).  Mr. Wu has forwarded a report from a national evaluation service stating that his study at that school was equivalent to four years of postsecondary study in the United States.

 

As part of the review of Mr. Wu's education credentials, the Department wrote to the Department of Education of Anhui Province of the People's Republic of China seeking information regarding governmental recognition of Huatuo College of TCM.  The Department of Education of Anhui Province replied that Huatuo College of TCM is a U.S. registered college, which uses the name Huangshan University of Medicine but has no substantive connection with that University.  Further, they stated that Huangshan University of Medicine was not qualified to issue diplomas. Additionally, Department staff have found no evidence that Huatuo College of TCM was accredited by an acceptable accrediting agency in the United States. Consequently, Mr. Wu's study at Huatuo College of TCM cannot be accepted to satisfy the preprofessional education requirement.

 

After Mr. Wu was informed that his preprofessional education was not acceptable, he enrolled in ASA Institute of Business and Computer Technology in Brooklyn, New York, and completed 60 credits, including 9 credits in biosciences He was awarded an A.O.S. degree in January 2005.  Mr. Wu asks that this study be accepted to satisfy the preprofessional education requirement.  Department staff support his petition.

 

APPLICABLE REQUIREMENTS:

 

QUALIFICATIONS:

Section 8214 of the Education Law and 79-2.1 of Commissioner's Regulations require:

 

(1) Two years of satisfactory preprofessional college study.

(1) ASA Institute of Business and Computer Technology, Brooklyn, New York, A.O.S., January 30, 2005.


 

(2)  Completion of a satisfactory acupuncture program.

NURSE PRACTITIONER IN PSYCHIATRY

Petition for:  Acceptance of experience for nurse practitioner certification under alternative criteria.

 

Statement of Problem:  Ms. Stone holds New York State certification as a nurse practitioner in family health issued on the basis of her completion of the Family Health Nurse Practitioner program at the State University at Binghamton, Binghamton, New York.  She is petitioning for nurse practitioner certification in the additional specialty area of psychiatry under alternative criteria.

 

          For certification in an additional specialty area under alternative criteria, Commissioner's Regulations require, in addition to appropriate education, evidence of one thousand hours of clinical practice in the specialty area in which the additional certification is sought in a health care facility licensed pursuant to Article 28 of the Public Health Law.  Ms. Stone reports that she worked as a nurse practitioner in psychiatry at United Health Services Hospital, an Article 28 facility, from 1983-87, but that the physicians she worked with are now deceased.  Ms. Stone has documented additional experience as a nurse practitioner in psychiatry from August 2000 to the present time at the Catholic Charities of Broome County, Binghamton, New York.  She asks that this experience be accepted as the substantial equivalent of experience in an Article 28 facility.  The Executive Secretary of the State Board for Nursing supports her request.

 

APPLICABLE REQUIREMENTS:

 

QUALIFICATIONS:

Section 64.4 of the Regulations of the Commissioner of Education requires under alternative criteria:

 

(1)  Sixty hours of continuing education in the specialty area in which certification is sought. 

(1)  Sixty hours of continuing education in the area of psychiatry. 

(2) One thousand hours of clinical practice in the specialty area in which additional certification is sought in a health care facility licensed pursuant to Article 28 of the Public Health Law.

(2) More than 1,000 hours of experience as a nurse practitioner in psychiatry at Catholic Charities of Broome County, Binghamton, New York from August 2000 through December 2004. 


 

(3) Completion of an acceptable course of at least three semester hours or the equivalent in pharmacology. 

3) Completed three semester hours in pharmacology as part of her Family Health Nurse Practitioner program at the State University at Binghamton, Binghamton, New York, 1983.

 

RECOMMENDATION:   The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Nursing, recommends that the applicant’s petition for acceptance of 1,000 hours of experience as a nurse practitioner at Catholic Charities of Broome County, Binghamton, New York as the substantial equivalent of experience in a health care facility licensed pursuant to Article 28 of the New York State Public Health Law be accepted to satisfy the requirement for nurse practitioner certification under alternative criteria. 


 

DIETETICS-NUTRITION

Petition for:  Waiver of New York State requirements pertaining to experience.

 

Statement of Problem:   Julia Lapp became a Registered Dietitian (RD) on October 16, 1993 when she met the requirements of the Commission on Dietetic Registration by completing an accredited master’s degree program that included an internship and attaining a passing score on the registered dietitian examination.  Ms. Lapp does not qualify for licensure through the baccalaureate degree route as she has 38 semester hour credits in the professional dietetics and nutrition content whereas 45 semester hour credits are required. However, she has completed the content and distribution education requirements for the associate degree route. For this route, 10 years of education and experience credit within the last 15 years is required.  The experience must include 2.5 years of planned work experience and all of the experience must be supervised.  Other RDs have verified nine years of experience for Ms. Lapp and she completed an internship that qualifies as planned work experience but it was not 2.5 years in length.  Not all of Ms. Lapp’s experience has been directly supervised.

 

Based on the unique qualifications of the applicant, the Executive Secretary of the State Board for Dietetics and Nutrition recommends that the education and experience requirements, including the planned work experience, be considered satisfied for Ms. Lapp through the associate degree licensure route.

 

APPLICABLE REQUIREMENTS:

 

QUALIFICATIONS: 

Section 8004(2) of the Education Law and Part 79-6 of the Commissioner's Regulations require:

 

(a)(1)  An associate degree based on a program in dietetics or nutrition which includes the equivalent of at least 30 semester hours in the nine curricular areas that constitute the professional dietetics and nutritional content area and at least 15 semester hours in the human biological sciences and social and behavioral sciences content area, and

 

(a)(2)  Completion, in the 15 years preceding application, of 10 full-time equivalent years of experience and education in the field of dietetics and nutrition, including a minimum of 2.5 equivalent years of planned work experience,  acceptable to the New York State Board for Dietetics and Nutrition, and

 

(b)  Endorsements from three dietitians or nutritionists acceptable to the Department.

DENTISTRY

Petition for:  Acceptance of education.

 

Statement of Problem:  Dr. Kim did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. 

 

          Dr. Kim is expected to complete the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester in June 2005. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation. Dr. Kim asks that her study at the Eastman Dental Center of the University of Rochester, when completed, be accepted to satisfy Commissioner's Regulations.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 61 of the Regulations of the Commissioner of Education require:

 

(1) Not less than 60 semester hours of preprofessional education including courses in general chemistry, organic chemistry, biology or zoology, and physics.

(1) Yonsei University, Seoul, Korea, 1989-91.

(2) Four academic years of dental education culminating in a degree in an acceptable dental school.

(2) Four years of acceptable dental education culminating in the degree of Doctor of Dental Surgery from Yonsei University, Seoul, Korea, 1995.


(3) Two academic years of study in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.

(3) Two-year advanced program in general dentistry at the University of Rochester, Eastman Dental Center, to be completed June 2005.

(4) Satisfactory scores on Parts I and II of the National Dental Board Examinations.

(5) Satisfactory performance on the clinical examination administered by the Northeast Regional Board of Dental Examiners.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Dentistry, recommends that the applicant's advanced program in general dentistry at the University of Rochester be accepted as the substantial equivalent of the required two academic years of dental study in a registered or accredited dental school program upon documentation of satisfactory completion.


THREE YEAR LIMITED LICENSE IN DENTISTRY

 

Petition for: Three-year limited license to practice Dentistry under Section 6604(6) of the Education Law.

 

Statement of Problem: The applicants listed below have satisfied the education and examination requirements for licensure as a dentist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          Each applicant has an opportunity to practice dentistry in an area which has been designated a Federal Dental Health Professions Shortage Area and requests a three-year waiver of the citizenship requirement under Section 6604(6) of the Education Law. Each applicant must sign an affidavit stating the exact location of the shortage area where he/she will practice before the three-year limited license will be issued.

 

Applicable Guidelines: Section 6604(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a dentist in New York State and allows the Board of Regents to grant a one-time, three-year waiver of this requirement for an alien dentist to practice in New York State if all other licensure requirements are satisfied and to grant an additional extension not to exceed six years to enable the alien to secure citizenship or permanent resident status, provided such status is being actively pursued.

Petition for: Acceptance of more than seven years of experience as a speech therapist in the Social Security Clinic Rafael Uribe Uribe, Cali, Colombia as the substantial equivalent of the required 150 clock hours of graduate level practicum.

 

Statement of Problem: Ms. Guerrero earned a Speech Language Pathology and Audiology degree from Universidad del Rosario in 1995 and an Especialista in Health Administration from Pontificia Universidad Javeriana in 1998.  Her studies meet all educational requirements for speech-language pathology licensure in New York State except for 150 clock hours of graduate level practicum.

 

From October 1995 through June 2003, Ms. Guerrero worked as a speech therapist and audiologist at the Social Security Clinic Rafael Uribe Uribe in Cali, Colombia. Her work included evaluation and treatment of infants, children and adults in both clinic and hospital settings.  She asks that her more than seven years of experience as a speech therapist be accepted as the substantial equivalent of the required 150 clock hours of graduate level practicum.  In February, the Executive Secretary of the State Board for Speech-Language Pathology expressed support for the applicant’s request.

 

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 8206 of the Education Law and Part 75 of the Commissioner’s Regulations require:

 

(1) Completion of a registered program in speech-language pathology leading to the master’s degree or the equivalent, as determined by the Department, including specified coursework.

(1) Universidad del Rosario, Bogota, Colombia, Fonoaudiologia, August 1995; Pontificia Universidad Javeriana, Cali, Colombia, Especialista, May 1998.

(2) Not less than nine months of satisfactory supervised experience following completion of a program that meets the above requirements.

 

(3) Satisfactory grades on the uniform examination in speech-language pathology.

 

 

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Speech-Language Pathology, recommends that the applicant’s petition for acceptance of more than seven year’s experience as a speech therapist and audiologist at the Social Security Clinic Rafael Uribe Uribe as the substantial equivalent of the required 150 clock hours of graduate level practicum be accepted.

 

PHYSICAL THERAPIST ASSISTANT

Petition for:  Acceptance of education as being the substantial equivalent of a registered program.

 

Statement of Problem:  Mr. Shneider did not complete a physical therapist assistant or physical therapy program as required for licensure as a physical therapist assistant.  He successfully completed the entire entry-level BS/MS physical therapy program at Long Island University except for one of the five clinical practice courses.  The applicant is requesting that his studies for which the college gave him credit (including 26 weeks of attendance at clinical sites for 1040 hours of clinical education) be considered equivalent to an approved program for physical therapist assistants.

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

Section 6740 of the Education Law and Part 77 of the Regulations of the Commissioner of Education require:

 

(1)  Completion of a two-year New York State registered licensure-qualifying program or a college program accredited by the American Physical Therapy Association (APTA) for physical therapist assistants

OR

Completion of a physical therapy program determined by the department to be the equivalent to a registered physical therapist assistant program.

(1)  Kingsborough Community College, Brooklyn, New York, A.S., January 1999; Long Island University, Brooklyn Campus, Brooklyn, New York, enrolled summer 2000 – summer 2003 in an approved physical therapy program and earned 200 semester credits (including 82 transfer credits).

(2)  Evidence of good moral character.

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Physical Therapy, recommends that the applicant's education be accepted as the equivalent of a registered physical therapist assistant program upon documentation of passing scores on the national physical therapy or physical therapist assistant examination.


PSYCHOLOGY

Petition for:  Acceptance of education.

 

Statement of Problem:  Commissioner's Regulations require a doctoral degree in psychology and a minimum of 30 semester hours of coursework obtained at the doctoral degree-granting institution to satisfy the professional education requirements for licensure as a psychologist. Dr. Chellappan earned a Master of Arts degree in psychology at Annamalai University, Chidambaram, Tamil Nadu, India in 1993 and a Master of Philosophy degree in medical and social psychology at the Central Institute of Psychiatry (Ranchi University), Ranchi, India in 1996.  He began doctoral studies in 1996 in the National Institute of Mental Health and Neurosciences, Bangalore, Karnataka, India, earning the degree of Doctor of Philosophy in Clinical Psychology in November 2001.  Admission to the doctoral program was based on the Master of Philosophy in medical and social psychology he earned in 1996 from Ranchi University.

 

Dr. Chellappan's study at the three universities included the required coursework in scientific and professional ethics and standards of practice, and issues of cultural and ethnic diversity, and at least three semester hours in each of the following required substantive content areas: biological basis of behavior, cognitive-affective basis of behavior, social basis of behavior, individual difference, psychometrics, history and systems of psychology, and research design, methodology, and statistics.  In addition, his studies included a supervised practicum. The doctoral program at the National Institute of Mental Health and Neurosciences did not include formal coursework.  However, a review of the program indicates that it included sufficient seminars and tutorials such that the study could be equated to 30 semester hours, as required for the doctoral program.  Dr. Chellappan asks that his education be accepted to satisfy the professional education requirement for licensure. The Executive Secretary of the State Board for Psychology supports his petition.

 

APPLICABLE REQUIREMENTS:

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

 

Statement of Problem:   Dr. Herron graduated from an accredited college of veterinary medicine in 1975.  Dr. Herron passed the June 1975 National Board Examination (NBE) but has not taken the Clinical Competency Test (CCT) which was offered only from 1984 to 2000.  For New York State licensure, applicants who passed the NBE must also take the CCT.  Both the NBE and the CCT have been replaced by the North American Veterinary Licensing Examination (NAVLE).

 

Dr. Herron was licensed in Indiana in 1975 and in Florida in 1976.  He has documented nineteen years of professional practice in Florida. 

 

In view of Dr. Herron’s documentation of numerous years of practice as evidence of clinical competence, the Executive Secretary of the State Board for Veterinary Medicine recommends that the CCT examination requirement be waived and the applicant’s Florida license be accepted for endorsement in New York State.

 

APPLICABLE REQUIREMENTS:

Section 6704 of the Education Law and Section 59.6 and Part 62 of the Regulations of the Commissioner of Education:

Statement of Problem: The applicants listed below have met the education and examination requirements for licensure as veterinarians in New York State. Petition for:  Endorsement of a French medical license and acceptance of hospital training completed in France as the substantial equivalent of three years of ACGME-accredited postgraduate hospital training.

 

Statement of Problem:  Dr. Jan completed his medical studies at the Universite Pierre et Marie Curie in 1978 and received his medical degree in 1984. Upon receipt of his medical degree, he was licensed in France. Commissioner’s Regulations allow endorsement of an applicant’s license from another jurisdiction if appropriate requirements are met. One of the requirements is the satisfactory passing of an acceptable licensing examination.  Commissioner’s Regulations also state that an applicant for endorsement cannot have failed any part of New York State’s licensing examination. At the present time, New York State requires acceptable scores on Steps 1, 2, and 3 of the United States Medical Licensing Examination (USMLE). Dr. Jan has never attempted this examination sequence.  He requests that his French license obtained by examination be endorsed.  The Executive Secretary for the State Board for Medicine recommends that the licensing examination he completed in France be accepted for endorsement.

 

Dr. Jan completed a residency in general surgery and surgery specialties from January 1978 to September 1984 at Assistance Publique, Paris, France and a fellowship in pediatric surgery from October 1, 1984 to September 30, 1987 at Necker Enfants Malades, Paris, France. He requests that his French hospital training be considered the substantial equivalent of the three years of ACGME-accredited postgraduate hospital training required for licensure.

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

LAND SURVEYING

Petition for:  Acceptance of experience.

 

Statement of Problem:  The applicant is appealing the determination of the New York State Board for Engineering and Land Surveying that he needs additional acceptable experience for licensure.  

 

Mr. Wagner feels the review of his experience was arbitrary and capricious as, despite additional documentation he submitted, he was granted only six years and six months credit out of the twelve years and one month experience he documented.  He also protests the areas in which he is required to document satisfactory experience.  He states that he has experience in the legal aspects of the profession and feels that being required to “demonstrate Experience in Responsible charge of the office aspects of the profession” should be illegal as he believes only a licensed land surveyor can be “in responsible charge of all work performed under him.”  Also, Mr. Wagner notes that he qualified for North Carolina licensure and that state verified that he was issued a license on September 7, 2000.

 

Mr. Wagner reports that he has completed approximately 90 hours of postsecondary education with a major in mathematics. However, since his postsecondary study has not been in land surveying, Part 68 of the Regulations of the Commissioner of Education requires that he submit documentation of eight years of practical work experience satisfactory to the New York State Board and that he successfully complete licensing examinations.  At this time, it appears he has passed two of the three examinations required for licensure as a land surveyor in New York State.  Section 68.5 of Regulations specifies that practical experience in land surveying “ satisfactory” to the Board be verified in a manner “acceptable” to the Board.  This section also requires that the applicant demonstrate, among other aspects, “adequate experience in charge of the office aspects of the application” (defined by the State Board as evaluation and analysis of field data, maintenance of survey records, client contact, and supervision of office personnel) as well as “experience in the legal aspects of the profession” (defined by the State Board as research of private and public records necessary to trace title documents, preparation of final survey results and contract preparation).   The State Board indicates that these tasks are not the same as being in overall charge of the project.

 

The applicant’s documented prelicensure experience in New York State and North Carolina has been reviewed three times by two New York State Board members who are licensed land surveyors.  Both Board members are in agreement that the experience that has been submitted by the applicant does not meet all the requirements of Section 68.5 of the Regulations.  The applicant was notified in writing of the Board member’s determination after each review.  The Department sends letters to all land surveying licensure applicants who have not met the requirements for licensure. The letter identifies the areas where the applicant’s experience has not met the requirements of the Regulations based on a review and evaluation by a State Board member..  Due to a clerical error, one letter had the wrong box checked off but this was corrected by the reviewer and so noted in a subsequent letter to the applicant.

 

The Committee on the Professions has reviewed the documentation submitted in support of Mr. Wagner’s application for licensure as a land surveyor in New York State, including the supplemental information he submitted to the Committee on November 2, 2004 and November 28, 2004. The Committee notes that two independent reviews by Land Surveying members of the New York State Board for Engineering and Land Surveying concluded that Mr. Wagner’s experience as submitted does not meet all of New York State’s requirements for licensure and, consequently, he does not qualify to sit for the New York State Specific Examination that is required before licensure in New York State.  The additional documentation he submitted after being initially notified of experience deficiencies was considered. The Committee notes that the determination of experience credit was in accordance with State Board procedures and that all documentation submitted by Mr. Wagner was considered.  After reviewing the total record, the Committee finds that Mr. Wagner has not submitted any evidence that the State Board experts in land surveying erred in assessing petitioner’s experience documentation.made any errors in professional judgment.

Section 7206-a of the Education Law and Part 68 of the Regulations of the Commissioner of Education require:

 

(1)  Approved bachelor's degree in land surveying and four years of acceptable experience or eight years of acceptable combined education and experience credit.
