THREE-YEAR LIMITED LICENSE IN PHARMACY

 

Petition for: Three-year limited license to practice pharmacy under Section 6805(6) of the Education Law.

 

Statement of Problem:

 

The applicant listed below has met the education, examination and experience requirements for licensure as a pharmacist in New York State. The only requirement for full licensure that cannot be satisfied at this time is United States citizenship or immigration status as an alien lawfully admitted for permanent residence in the United States.

 

          The applicant also has a pending application for full pharmacy licensure, which cannot be granted until he satisfies the citizenship or permanent residency requirement.

 

Applicable Guidelines:

 

Section 6805(6) of Education Law relates to the requirement of United States citizenship or permanent resident status for licensure as a pharmacist in New York State and allows the Board of Regents to grant a one-time three-year waiver (plus an extension of not more than one year) for an alien pharmacist to practice in New York State if all other licensure requirements are satisfied.

Petition for:  Acceptance of education.

 

Statement of Problem:  Dr. Kirkby did not complete the two academic years of study required in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.  Such study is required for applicants completing a program of dental education in an unregistered or unaccredited dental school. 

 

          Dr. Kirkby is expected to complete the two-year advanced program in general dentistry at the Eastman Dental Center of the University of Rochester on December 31, 2004. This program is acknowledged by the State Board for Dentistry as the substantial equivalent of the two-year program required in regulation.

 

 

APPLICABLE REQUIREMENTS:

QUALIFICATIONS:

 Section 61 of the Regulations of the Commissioner of Education requires:

 

(1) Not less than 60 semester hours of preprofessional education including courses in general chemistry, organic chemistry, biology or zoology, and physics.

(1) Two years of preprofessional education as part of studies at Moscow Medical Stomatological Institute, Moscow, Russia, 1984-86.

.

(2) Four academic years of dental education culminating in a degree in an acceptable dental school.

(2) Four years of acceptable dental education culminating in the degree of Stomatologist at Moscow Medical Stomatological Insitute, Moscow, Russia, 1990.


(3) Two academic years of study in an accredited dental school program culminating in certification that the applicant has achieved the level of knowledge and clinical proficiency expected of a graduate of that school.

(3) Two-year advanced program in general dentistry at the University of Rochester, Eastman Dental Center, Rochester, New York, expected to be completed on December 31, 2004.

(4) Satisfactory scores on Parts I and II of the National Dental Board Examinations.

(4) Acceptable scores on Part I (July 2002) and Part II (October 2003) of the National Dental Board Examinations.

(5) Satisfactory performance on the clinical examination administered by the Northeast Regional Board of Dental Examiners.

(6) United States citizen or alien lawfully admitted for permanent residence in the United States.

(7) Evidence of the required course in the identification and reporting of child abuse and maltreatment.

RECOMMENDATION: The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Dentistry, recommends that the applicant's advanced program in general dentistry at the University of Rochester, once verified as completed, be accepted as the substantial equivalent of the required two academic years of dental study in a registered or accredited dental school program.


 

OPTOMETRY

Petition for:  Waiver of New York State practical examination requirement.

 

Statement of Problem:  Dr. Marnul has not passed a satisfactory practical examination, as required for licensure, either by the endorsement or examination route.  New York State accepts a passing score on Part III of the examination of the National Board of Examiners in Optometry (NBEO) to satisfy the practical examination requirement.  The NBEO practical examination was not available when Dr. Marnul was licensed in Illinois in 1982. 

 

Dr. Marnul has documented over 20 years of licensed practice and was certified in the use of diagnostic pharmaceutical agents and therapeutic pharmaceutical agents. In addition to passing Parts I and II of the NBEO examinations, which were required for licensure, he has also passed the Treatment and Management of Ocular Disease (TMOD) examination, which is currently required for certification to use therapeutic pharmaceutical agents in New York State.

 

Based on Dr. Marnul' s demonstration of clinical skills through his years of hands-on licensed practice and his success on other professional examinations, the Executive Secretary of the State Board for Optometry recommends that the requirement for a satisfactory practical examination (NBEO Part III) be waived.

 

APPLICABLE REQUIREMENTS: 

QUALIFICATIONS:

Section 7104 of the Education Law and Part 66 of the Regulations of the Commissioner of Education require:

 

(1) Approved Doctor of Optometry degree, or the equivalent, earned on completion of an acceptable optometry program.

(1) Illinois College of Optometry, Chicago, Illinois, O.D., May 1982.


 

(2) Acceptable scores on a satisfactory written licensing examination; OR

an optometry license issued by another jurisdiction with at least five years of professional practice of optometry following initial licensure and within the 10 years immediately preceding application for licensure by endorsement.

(2)(a) National Board of Examiners in Optometry (NBEO) Part I, April 1980; Part IIA, April 1981; and Part IIB, April 1982.  [Also passed Treatment and Management of Ocular Disease (TMOD), April 2004.]

 

(2)(b) Licensed in Illinois, August 1982; over 20 years of professional practice.   

(3) Acceptable scores on a satisfactory practical examination.

VETERINARY MEDICINE

Petition for:  Waiver of New York State requirements pertaining to acceptability of licensing examinations for licensure by endorsement.

 

Statement of Problem:   Dr. Dupree graduated from an accredited college of veterinary medicine in 1982.  Dr. Dupree passed the December 1981 National Board Examination (NBE) but has not taken the Clinical Competency Test (CCT), which was offered only from 1984 to 2000.  For New York State licensure, an applicant who passed the NBE must also pass the CCT.   Both the NBE and the CCT have been replaced by the North American Veterinary Licensing Examination (NAVLE).

 

Dr. Dupree became licensed in Louisiana in 1982 and in Pennsylvania in 1998 based on the NBE.  He has documented approximately 22 years of professional practice in Louisiana and Pennsylvania.

 

In view of Dr. Dupree’s documentation of 22 years of practice as evidence of clinical competence, the Executive Secretary of the State Board for Veterinary Medicine recommends that the CCT examination requirement be waived and that the applicant’s license be accepted for endorsement in New York State.

 

APPLICABLE REQUIREMENTS: 

QUALIFICATIONS:

Section 6704 of the Education Law and Section 59.6 and Part 62 of the Regulations of the Commissioner of Education require:

 

(1) Completion of six years of preprofessional and professional postsecondary studies satisfactory to the Department, including satisfactory clinical education, and graduation with a satisfactory degree in veterinary medicine.

(1)  Louisiana Tech University, Ruston, Louisiana, B.S. in Animal Science, 1978; Louisville University, School of Veterinary Medicine, Baton Rouge, Louisiana, D.V.M., 1982.  

(2) Acceptable scores on satisfactory licensing examinations or passing scores on an acceptable state licensing examination not in use in New York State and at least two years’ satisfactory professional experience following licensure.

(2)(a) Passing score on December 1981 NBE examination; did not take the CCT.

 

(2)(b) Licensed as a veterinarian in Louisiana, June 1982, and in Pennsylvania, January 1998. 

 

(2)(c) More than 22 years of satisfactory professional experience following licensure.

(3) United States citizenship or immigration status as an alien lawfully admitted for permanent resident status in the United States.

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Veterinary Medicine, recommends waiver of the CCT examination requirement and endorsement of the applicant's license.

 


VETERINARY MEDICINE

Petition for:  Waiver of New York State requirements pertaining to acceptability of education and licensing examinations for licensure by endorsement.

 

Statement of Problem:   As a graduate of a veterinary medicine program not accredited by the American Veterinary Medicine Association, Dr. Stein is required to document completion of satisfactory clinical education equivalent to the clinical training in an accredited veterinary medical program, such as certification by the Educational Commission for Foreign Veterinary Graduates (ECFVG).  Dr. Stein is unable to document a year of clinical education and did not complete the ECFVG program.

 

In addition, Dr. Stein passed the December 1982 National Board Examination (NBE) but not the Clinical Competency Test (CCT).  For New York State licensure, an applicant who passed the NBE must also pass the CCT, which was offered from 1984 until 2000.   The CCT and the NBE have been replaced by the North American Veterinary Licensing Examination (NAVLE).  For licensure in California, Dr. Stein passed the California State Board Exam, a written (practical) examination, in addition to the NBE examination, and has practiced in that state since 1984. 

 

In view of Dr. Stein’s documentation of over 19 years of licensed professional practice as evidence of clinical competence, the Executive Secretary of the State Board for Veterinary Medicine recommends that the applicant’s California license be accepted for endorsement in New York State, waiving the requirements of the CCT examination and satisfactory clinical training.

 

APPLICABLE REQUIREMENTS: 

QUALIFICATIONS:

Section 6704 of the Education Law and Part 62 of the Regulations of the Commissioner of Education require:

 

(1) Completion of six years of preprofessional and professional postsecondary studies satisfactory to the Department, including satisfactory clinical education, and graduation with a satisfactory degree in veterinary medicine.

(2) Acceptable scores on satisfactory licensing examinations or passing scores on an acceptable state licensing examination not in use in New York State and at least two years’ satisfactory professional experience following licensure.

(2)(b) Licensed in California, March 12, 1984.

 

(2)(c) More than two years of satisfactory professional experience following licensure.

(3) United States citizenship or immigration status as an alien lawfully admitted for permanent resident status in the United States.

RECOMMENDATION:  The Committee on the Professions, in concurrence with the Executive Secretary of the State Board for Veterinary Medicine, recommends that the clinical education requirement and the clinical competency test examination requirement be waived and that the applicant’s California license be endorsed. 


 

MEDICINE

 

Petition for: Conferral of the degree Doctor of Medicine (M.D.) pursuant to Section 6529 of the Education Law.

 

Summary Statement: The petitioners listed below are all graduates of foreign medical schools who have been licensed in New York.

 

          The applicable requirements of Section 3.57 of the Rules of the Board of Regents require completion of a medical education program in a foreign medical school satisfactory to the Department which does not grant the degree Doctor of Medicine (M.D.), and in which the philosophy and curriculum were equivalent, as determined by the Department in accordance with the policy of the Board of Regents, to those in programs leading to the degree Doctor of Medicine (M.D.) at medical schools in the United States satisfactory to, or registered by, the Board of Regents and the Department.  Secondly, petitioners must have licensure to practice medicine in New York State in accordance with provisions of Section 6524 or 6528 of the Education Law or their equivalent as determined by the Board of Regents pursuant to their authority under Section 6506 of the Education Law.
