SUMMARY:

On December 12, 2003 the Board of Regents voted to approve the three charter school applications pursuant to Article 56 of the Education Law.  Thereafter, pursuant to Article 56 of the Education Law, the Board of Regents, as the charter entity, is required to enter into agreements allowing the applicants to organize and operate charter schools. The proposed charter agreements are attached.  In addition, complete copies of the applications for the schools listed below, which will be included as Ex. A to the charter agreements, are available for your review by contacting James R. Butterworth at 518-474-4817.

Upon final approval of the charter agreements by the Board of Regents, the charters are formally issued.  Simultaneously, the Board of Regents incorporates the charter schools as education corporations by issuing provisional charters pursuant to Education Law §§216 and 217.

VOTED:  That the Board of Regents approve the charter agreements and issue charters pursuant to Article 56 of the Education Law for the following charter schools, and incorporate such schools by granting each a provisional charter for a period of five years:

Buffalo Academy of Science

·        Charter School, Buffalo

·        Charter School of Educational Excellence, Yonkers

·        Western New York Maritime Charter School, Buffalo
